RECOMMENDATION MODIFY September 14, 1993 Board approval of lease for 2727 Alhambra Avenue, Martinez (Teamsters Building) with the General Truck Drivers, Warehousemen, Helpers and Automotive Employees of Contra Costa9County, Local 315, for use by the Health Services Department. II . FINANCIAL IMPACT Modification of the September 14, 1993 Board approval will reduce the level of financial commitment required for the lease. III. REASONS FOR RECOMMENDATION/BACKGROUND The lease agreement approved by your Board on September 14, 1993 for use of the Teamsters Building in Martinez contained a provision for approval of a hazardous materials report by the County prior to execution of the. lease. This provision was included since a service station had been located on this site over 30 years ago. The completed report indicates subsurface contamination of undetermined extent and origin on the site. The level of contamination does not constitute any threat to health. Cy G ATTESTED /i T Contact: PHIL BATCHELOR,CLERK OF THE BOARD OF cc: SEE PAGE 2 SUPERVISORS AND COUNTY ADMINISTRATOR BY DEPUTY -2- County staff, working in cooperation with Teamster representatives, ordered further investigation, including establishing three monitoring wells . It is believed that the contamination is a result of the service station, but testing by two different laboratories does not absolutely confirm this . The Teamsters are continuing to work with County Environmental Health staff to monitor this situation. County Counsel has advised that the risk to the County as a public agency for purchase or lease as the majority tenant in this site can be substantial and unlimited. The site would have been a valuable asset for use by the Health Services Department due to its proximity to Merrithew Hospital. However, the potential liability as determined by County Counsel precludes further consideration of purchase or substantial use of the site_. It is the opinion of County Counsel that the County could be a minor tenant at the site and enter a license agreement for use of parking spaces . Therefore, it is recommended that the September 14, 1993 approval be modified to reflect a reduction in the amount of space to be leased and authorization to enter into a license agreement for use of parking spaces .
