SUBJECT: Approving Empire Avenue Widening Project, Oakley Area.
Project No. 0662-6R4236, CP # 93-58.
Specific Request(s) or Recommendations) & Background & Justification
I. RECOMMENDED ACTION:
FIND, on the basis of the initial study and all comments received, that there is no substantial
evidence that the project will have a significant effect on the environment,
ADOPT the Negative Declaration in compliance with the California Environmental Quality Act,and
DIRECT the Public Works Director to begin right of way acquisition and to prepare contract
plans and specifications for construction.
DIRECT the Director of Community Development to file a Notice of Determination and a
Certificate of Fee Exemption: De Minimis Impact Finding with the County Clerk.
DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the
County Clerk.
II. FINANCIAL IMPACT:
The estimated project cost is $333,500, funded by Oakley/N. Brentwood Area of Benefit (76%),
State Transportation Partnership Program (10%), Deferred Improvement Agreement (9%), and
Developer Contributions (5%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project consists of widening Empire Avenue from Bedford Lane north to approximately 800
feet south of Oakley Road.

It is needed to provide traffic capacity for the travel corridor.
The project has been determined to be in,compliance with the General Plan. A Negative
Declaration of environmental significance pertaining to this project was published October 15,
1993 with no protest, and the Board has considered the negative declaration together with all
comments received during the public review period.
This project has been found to be de minimis in its effect on the environment and is exempt from
the $1,250.00 Fish and Game filing fee.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction and may
jeopardize funding.

Project Description, Common Name (if any) and Location: EMPIRE AVENUE WIDENING, County File
#CP 93-58: The project consists of widening Empire Avenue from Bedford Lane north to
approximately 2010' south of Oakley Road in the Oakley Area. The project is needed to fill in the gaps
of road improvements between existing completed subdivisions. Empire Avenue currently has one lane
in each direction. The ultimate widening begins at Bedford Lane and extends approximately 70' north
of EI Monte Drive. The interim widening occurs north of EI Monte Drive to approximately 200' south
of Oakley Road. As the adjacent frontage develops in the interim widening area, the subdivision
developer is conditioned to complete the improvements. The ultimate configuration will provide the
following features: (1) Two traffic lanes and a bike lane in each direction; (2) Drainage inlets and
drainage pipe, relocation of drainage ditch; (3) Median island with left tum lanes, sidewalks, curb and
gutter, and upgrading of wheel chair ramps at intersections; and (4) Empire Avenue may receive a
surface treatment and will ,be striped along the entire length of the project. Project location is
described as follows: The project is located in the east county area of Oakley. The area consists of
mostly residential development with some undeveloped parcels.
