SUBJECT: Granting of a Franchise to Operate Pipelines in County Roadways.

The Board of Supervisors of Contra Costa County Resolves that:
1. A written application has been made by Tosco Refining Company to the
Board of Supervisors for a franchise to install and/or operate various pipelines in
those roads described in the "Notice of Sale of Franchise" attached hereto. It is
proposed to grant such franchise in the manner provided by law, substantially in
the form and upon the terms and conditions set forth in the attached "Notice of
Sale of Franchise" and Ordinance No. 1827 (as amended by Ordinance No. 79/50
and Ordinance No. 92/64), and it is in the public interest to give this notice.
2. The Board of Supervisors hereby fixes December 7, 1993, at 11:00 a.m. as
hearing date and time and the Clerk of the Board is hereby authorized and
directed to advertise by publishing the attached"Notice of Sale of Franchise" in the
Contra Costa Times and the Antioch Ledger, newspapers of general circulation,
printed and published in this County, at least once within fifteen (15) days after the
passage of this Resolution.

RESOLUTION NO. 93/678
NOTICE OF SALE OF FRANCHISE
(Pipelines in County Roads)
NOTICE IS HEREBY GIVEN:
I. An application has been made to the Board of Supervisors of the County of Contra Costa,State
of Califomia, by the Tosco Refining Company, for a franchise to operate, and/or to install and
operate pipelines along, under and across various County roadways as hereinafter described.
This Board proposes to grant this non-exclusive franchise for a term of twenty (20) years in
accordance with the terms set forth in Contra Costa County Ordinance No. 1827 (as amended
by Ordinance No. 79/50 and Ordinance No. 92/64):
A. One four(4) inch natural gas pipeline crossing Cypress Road approximately 700 feet east
of the A.T. & S.F. Railroad (lineal distance approximately 60 feet);
S. One six (6) inch natural gas pipeline crossing County Road No. 8774 (lineal distance
approximately 60 feet);
C, One six (6) inch natural gas pipeline crossing Taylor Road (County Road 89878) at south
side of Canal Road intersection (lineal distance approximately 60 feet);
D. One eight (8) inch natural gas pipeline running longitudinally along Sunset Road for a
distance of approximately 10,500 feet between the west side of Sellers Avenue and the
east side of Byron Highway;
E. One eight(8) inch natural gas pipeline running longitudinally along Port Chicago Highway
for a distance of approximately 3,500 feet between Wharf Drive and Nichols Avenue.
F. One six(6) inch natural gas pipeline running longitudinally along Chestnut Street from the
East Contra Costa District canal a distance of approximately 2,350 feet until exiting the
County right-of-way at a point approximately 1,100 feet east of the intersection with Eden
Plains Road.
II. The grantee of this franchise and its successors and assigns will, during the life of the franchise,
pay to the County an annual fee as specified in Ordinance No. 1827 (as amended by Ordinance
No. 79/50 and Ordinance No. 92164). The fee shall be paid annually from the date of the
granting of the franchise. in addition, the grantee shall pay fees in arrears for certain pipelines
itemized in Section I of this "Notice of Sale of Franchise", specifically those described in
paragraphs B, C, and D. Fees for these pipelines shall be paid in arrears to the dates of their
installation. In the event payments are not made, the franchise shall be forfeited.
III. A public hearing has been set for December 7, 1993, at 11:00 a.m. All persons having any
objection to the granting of this franchise may appear before the Board of Supervisors and be
heard. At any time not later than the hour set for the hearing of objections, any person
interested may make a written protest stating objections against the granting of the franchise.
Any protests shall be signed by the protestant and delivered to the Clerk of the Board of
Supervisors.

Ff no protest in writing is delivered to the derk up to the hour set for hearing, or such protests as are
filed have been heard and determined by the legislative body to be insufficient, or have been overruled
or denied, the Board of Supervisors may grant the franchise.
