SUBJECT: GREEN VALLEY CREEK WILDLIFE MITIGATION PROJECT, DANVILLE AREA

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. APPROVE Right of Way Contract and ACCEPT Grant Deed dated October 14, 1993, from
Donald L. and Nancy D. Milan.
B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of the
District.
C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to
issue a check for $300.00 payable to Donald L. Milan and Nancy D. Milan, 62 Willowview
Court, Danville, CA., 94526, to be forwarded to the Real Property Division for delivery.
D. DIRECT the Real Property Division to have the above-referenced Grant Deed recorded
in the Office of the County Recorder.
II. Financiallm�tact:
Payment totalling $300.00 from Flood Control Zone 313, 100% reimbursable from the State
Department of Water Resources.

III. Reasons for Recommendations:
Recently the U.S. Army Corps of Engineers and the Flood Control District cooperated in a
revegetation and wildlife mitigation project along a section of Green Valley Creek in Danville.
While grading for a maintenance road, the contractor was directed to avoid established trees
and riparian habitat and, as a result, encroached on private property. Compensation consists
of payment for land rights required for the project.
IV. Background:
The project will not have sufficient land rights in accordance with approved plans and
specifications.
