SUBJECT: MOKELUMNE RIVER WATER RIGHTS HEARINGS; PORT OF STOCKTON ASSESSMENT

RECOMMENDATIONS
1. Authorize Chair to sign a second letter to the State Water
Resources Control Board regarding East Bay Municipal Utility
District (EBMUD) water rights on the Mokelumne River.
2 . Direct the Community Development to prepare a 90-day progress
report to the Port of Stockton regarding potential for County
assumption of local sponsorship for the portion of the Baldwin Ship
Channel between Avon and New York Slough.
BACKGROUND/REASONS FOR RECOMMENDATIONS
1. On November 3 , 1992 the Board of Supervisors authorized a letter
to the State Water Resources Control Board supporting the Lower
Mokelumne River Management Plan prepared by EBMUD, and requesting
further consideration of the Delta as a water source for EBMUD, in
order to provide additional flows on the Mokelumne River. The
Water Committee has requested that an additional letter be sent
requesting the State Water Resources Control Board to consider
requiring EBMUD to sign the Memorandum of Understanding (MOU) for
Urban Water Conservation, as part of any water rights decision made
by the Board. The MOU was prepared by the State Water Conservation
Coalition, reducing long-term urban water demand by implementation
of Best Management Practices.

2 . At the request of industry located in the east County area, the
County is looking into the potential for assumption of local
sponsorship of a portion of the Baldwin Ship Channel located
between Avon and New York Slough. The Stockton Port District,
currently the local sponsor for this area, has set up an assessment
district which includes assessments of local . industry as part of
this process. Industry has requested that any assessments
necessary come from Contra Costa County rather than San Joaquin
County. County Counsel, the County Administrator and the Community
Development Department have been involved in efforts to review the
potential for County take-over of local sponsorship for this
portion of the channel. Currently, the Army Corps of Engineers San
Francisco and Sacramento Districts are currently reviewing the
situation. Questions currently before the Corps are 1) can the
County assume Local Sponsorship responsibilities for this section
of the channel, and b) if not, can this section of the channel be
written out of the current contract which the Corps holds with the
Port of Stockton?
The Port of Stockton has given the County 6 months to accomplish
local sponsorship and financial assurance, prior to their
assessment district going into effect, and has requested a 90-day
progress report.
