SUBJECT. PROVISION FOR AUTHORIZING DISCRETIONARY LARGE LOAD DIRECT
HAULS TO KELLER CANYON LANDFILL

SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECONNENDED ACTION:
(1 ) Delegate to the Director of Community Development the
authority to determine the compliance (with Condition 8. 1 of the Land
Use Permit 2020-89 ) of discretionary proposals for direct haul to the
Keller Canyon Landfill, subject to the guidelines approved by the Board
of Supervisors on October 27, 1992, in accordance with Condition 11 . 13
of the Land Use Permit (LUP) .
( 2 ) Affirm that the Director of Community Development may
consider authorizing the direct haul of large loads of solid waste
from single establishments, in transfer-type vehicles, as described in
the Board of Supervisors' guidelines of October 27, 1992.
(3) Affirm that the Director of Community Development's
determinations in administering the direct haul provisions of
Condition 8. 1 of LUP are subject to appeal to the Board of
Supervisors, as provided for in Condition 11 .13 of the LUP.
FISCAL IMPACT:
None. The costs of administering the provisions of
Condition 8 . 1 of LUP 2020-89 which are not covered by the landfill and
transfer station operators will be directly billed to the
establishments proposing direct haul.

Supervisor Torlakson requested that the above process always include notifying the
City of Pittsburg, the Keller Canyon Advisory Committee and the West Pittsburg
Municipal Advisory Committee.

BACKGROUND INFORMATION: The Conditions of Approval of LUP
2020-89 for the Keller Canyon Landfill provide for the direct haul of
solid waste in a very limited set of circumstances where processing
through a transfer station is not practicable. The Board of
Supervisors on October 27, 1992, approved a Board Order containing
guidelines for administratively determining compliance with the direct
haul provisions of the permit. Authorization of ordinary direct hauls
by the Director of Community Development is well covered by the terms
of the LUP and the Board Order.
The October 27th Board Order also provided for the
consideration of the direct haul of large loads (e.g. , 20-ton loads )
of solid waste under specified circumstances; i.e. , originated by
single establishments, transport by transfer van vehicles, and
otherwise complying with inspection, peak-hour travel, and resource
recovery provisions of the LUP. Such consideration would also be
conducted in the context of goals to reduce unnecessary trips on our
highways and local streets and to reduce air pollution.
Authorizations of the direct haul of large loads would be
discretionary. Condition 11 . 13 of the LUP provides that the Boar of
Supervisors may delegate certain discretionary authorizations to
staff . This Board Order recommends that the authorization of large
loads be delegated to the Director of Community Development.
Condition 11 . 13 also provides that staff actions taken under this
provision are subject to appeal to the Board of Supervisors .
