SUBJECT PROPERTY IS LOCATED IN THE OAKLEY AREA. APPLICATION FILED BY J. PATRICK LAND CO. AND H & M INVESTMENTS. SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation prepared for this project as being adequate. 2 . Approve Rezoning Application 2952-RZ, D.P. 3011-91 and Subdivision 7630 subject to the conditions recommended by the East County Regional Planning Commission. 3 . Adopt the East County Regional Planning Commission's findings as set forth in Resolution No. 55-1992 as the determination for these actions. 4 . Introduce the ordinance giving effect to the aforesaid rezoning, waive reading and set forth date for adoption of same. BACKGROUND/REASONS FOR RECOMMENDATIONS This project is a result of the change in designation of the site from Single Family Residential, Low Density-Interim Agriculture to Single Family Residential Medium Density on the 1990 County General Plan. Since the project is a request to increase the original approval of 83 lots to 128 lots a Traffic Impact Study was required per Measure C (1988) . The report was done for this project as well as five (5) other pending residential developmentsof mo a than 100 lots in the Oakley area. The Developer agrees with the mitigation measures listed in the traffic report and to do their fair share of improvements except for the improvement of the rather distant Vasco Road-Marsh Creek Road intersection and the State Route 4-Lone Tree intersection which is in the City of Brentwood by prior agreement with the County is the responsibility of the City of Brentwood. On this basis a Negative Declaration of Environmental Significance was posted. On September 21, 1992, the East County Regional Planning Commission, after taking testimony, recommended that the Board of Supervisors approve this project for 128 lots with a 1.67 acre park area subject to the Conditions of Approval (Exhibit A) and findings attached. FISCAL IMPACT None ADDENDUM TO ITEM H . 5 NOVEMBER 24 , 1992 On November 17 , 1992, the Board of Supervisors deferred to this date the decision on the appeal by Symat Hillside Homes (appellant) from the decision of the Contra Costa County Planning Commission on the referral by the Board of Supervisors for a de novo hearing on the request by Symat Hillside Homes (applicant and owner) for approval of a revised tentative map (MS 206-90) to divide 1 . 83 acres into 3 lots in the Walnut Creek area . Dennis Barry, Community Development Department, advised that the applicant had met with the Public Works Department and reached agreement . Maurice Shiu, Public Works Department, advised of a meeting with the applicant and Supervisor Torlakson to resolve the issue of reimbursement of the developer for off-site improvements not on the priority list for the Oakley North Brentwood Area of Benefit . He advised of a recommendation from Michael Walford, Dated November 23, 1992, setting up a mechanism where the developer will be reimbursed within ten years and the development north of this development, when it occurs, will be required to reimburse the applicant for one half the cost of the construction work . He advised that the developer is agreeable . Supervisor Torlakson moved approval of the amended conditions reflecting the improvements and modifications . IT IS BY THE BOARD ORDERED that recommendations 1, 2 with amended conditions, 3 and 4 are APPROVED; Ordinance No . 92-93, giving effect to the rezoning is INTRODUCED, reading waived, and December 8, 1992 is set for adoption of same .
