SUBJECT: Proposed Adoption of Urgency Interim Ordinances for
Fire District Fees for Permit, Inspections, Plan-Checking
and Other Services

RECOMMENDATION:
Consider adopting urgency interim ordinances establishing and increasing fees
for permits, inspections, plan-checking, and other Fire Prevention Bureau
services for the Moraga, Orinda, •West County, Contra Costa County, Riverview,
Bethel Island, East Diablo and Oakley Fire Protection Districts.
REASONS FOR RECOMMENDATION/BACKGROUND:
Approximately eight years ago, the Board of Supervisors adopted fees for
permits, inspections, plan-checking and other Fire Prevention Bureau
functions for the Contra Costa County and the Riverview Fire Protection
Districts. The Riverview fee program also applies to the Bethel Island, East
Diablo and Oakley Fire Protection Districts.
The fee schedules were designed to partially cover the cost of fire
inspection activities and to enable the districts to add personnel to
increase the level of service as required by State and local codes and
ordinances.
The fees are based on the cost to the districts of providing the inspection
services and have been adjusted twice since the original fee adoption to
.reflect cost increases related to salary increases. The fees were last
adjusted in the fall of 1990. Accordingly, the districts have requested the
proposed increase to bring the fee schedule in line with current costs.

The adoption of fee schedules for the Moraga, Orinda and West County Fire
Districts is proposed to help cover the costs of fire inspection services in
these districts.
The recommended fees will result in estimated annual revenue increases as
follows:
District Amount
Contra Costa County $125,000
Moraga $ 7, 500
Orinda $ 5,000
Riverview (includes all East County Districts) $ 40,000
West County $ 40,000
The adoption of the proposed ordinances will result in uniform fire
prevention fees for all of the above-mentioned districts.
In a separate, but related, action on November 24, 1992, it is being
recommended that the Board of Supervisors hold a public hearing on
December 15 , 1992 to adopt ordinances setting fire inspection fees. However,
these fees will not become effective until 'February 14, 1993 .
The recommended urgency interim ordinances will become effective immediately
and will cover the time period prior to the effective date of the permanent
ordinances in February. If the urgency measures are not adopted, the fire
districts could lose as much as $50,000 during the interim period.
URGENCY INTERIM ORDINANCES OF THE BETHEL ISLAND (92- 84 ) , CONTRA
COSTA COUNTY (9 2- 85 ) , EAST DIABLO (9 2-86 ) , MORAGA (9 2- 87 ) ,
OAKLEY (92- 88 ) , ORINDA (92- 89 ) , RIVERVIEW (92- 90 ) , AND WEST
COUNTY (92- 91) , FIRE PROTECTION DISTRICTS ADOPTING FEES FOR
PERMITS, INSPECTIONS, PLAN-CHECKING AND OTHER SERVICES, AND
REPEALING ORDINANCE NUMBERS 90-43 THROUGH 90-48
The Board of Supervisors of Contra Costa County, as and
constituting the Board of Directors of the Bethel Island, Contra
Costa County, East Diablo, Moraga, Oakley, Orinda, Riverview, and
West County Fire Protection Districts, ordains as follows :
Section I . Repeal . Except as provided herein, Ordinances
Nos . 90-43 through 90-48 are hereby suspended during the
effective period of this ordinance.
Section II . Authority. This ordinance is enacted, in part,
pursuant to Health and Safety Code sections 13146 .2(b) , 13217 (b) ,
13869, 13871, 13916 and 17951, Government Code section 6103 . 7,
and the adopted provisions of the Uniform Fire Code.
Section III . Procedure. This ordinance was adopted in part
pursuant to the procedure set forth in Government Code section
66017 .
Section IV. Permit, Inspection, Plan-Checking and Other
Fees . Each person who applies for, requests or receives a
permit, inspection, plan review or other service furnished by
District shall, at the time of such application, request or
receipt, pay the applicable fee or fees listed in Exhibit "A"
attached hereto and incorporated by this reference. As used in
this Section, the term "person" means any natural person, firm
association, joint venture, joint stock company, partnership,
organization, club, company, corporation, trust or other type of
entity.
Section V. Severability. If any fee or provision of this
ordinance is held invalid or unenforceable by a court of
competent jurisdiction, that holding shall not affect the
validity or enforceability of the remaining fees or provisions,
and the Board declares that it would have adopted each part of
this ordinance irrespective of the validity of any other part.
Section VI . Prior ordinance. If this ordinance or any fee
established pursuant hereto is held ineffective, invalid or
unenforceable by a court of competent jurisdiction, such ruling
shall have the immediate effect of reinstating the ordinance and
each fee for the same or similar service suspended in Section I,
above. It is the Board's intention that during any period that
the higher fees established by this ordinance are deemed
ineffective, fees ,previously established pursuant to Ordinances
Nos. 90-43 through 90-48 shall remain in effect.
Section VII . Urgency Declaration. This ordinance is an
urgency measure as an interim authorization for increased fees or
charges to protect the public health, welfare and safety, as
authorized by Government Code section 66017 . There is an urgent
need for an increase in fees for permit, inspection, plan review,
and other services provided by the District. The fees currently
in effect do not reflect the cost to the District of the services
provided. The existing fees are a current and immediate threat
to the public health, safety and welfare because unless the fees
are increased to reflect the actual cost to the District of
providing these services, the ability of the District to provide
these and other life-preserving services will be curtailed.
Section VIII . Effective Date. This ordinance becomes
effective immediately upon passage and shall be operative for
thirty days pursuant to Government Code section 66017 . Within 15
days of passage, this ordinance or a summary thereof prepared by
the County Counsel shall be published once with the names of the
Supervisors voting for and against it in the Contra Costa Times,
a newspaper of general circulation published in this County.
