HomeMy WebLinkAboutMINUTES - 11171992 - H.7 H. 7 BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY Adopted this order on November 17, 1952 by the following vote : AYES : Supervisors Powers, Schroder, Torlakson and McPeak NOES: None ABSENT: Supervisor Fanden ABSTAIN: None SUBJECT: Hearing on Weidemann Ranch Residential Community, Rezoning File #2947-RZ, Preliminary Development Plan #3005-91, Subdivisions 7575 and 7578 and Agricultural Preserve Cancellation Requests in the San Ramon Area. On October 27, 1992, the Board of Supervisors continued to this date the hearing on the recommendation of the San Ramon Valley Regional Planning Commission on the certification of the Final Supplemental Environmental Impact Report for the Wiedemann Ranch Residential Community project; a request of HCV Pacific Partners (applicant) and Jeff and Nancy Wiedemann and Susan Christensen, et al (owners) to rezone 1, 143 acres of land from Agricultural Preserve (A-4) and General Agricultural (A-2) to Planned Unit District (P-1) (2947-RZ) ; a request for preliminary development plan approval (DP 3005-91) for 370 single family dwelling units/lots including three private open space lots and common area; a request for vesting tentative map approval (Subdivision 7575) to subdivide 1, 052 acres into 336 lots including three private open space parcels; and a request for approval of Petitions to cancel the restrictions of two Agricultural Preserve contracts (AP#16-70 and AP#5-76) affecting approximately 1, 128 acres of land, San Ramon area. Dennis Barry, Community Development Department, presented an oral staff report on the resolution of site plan items including the possible provision of open space lands to East Bay Regional Park District to augment Bishop Ranch Open Space, the provision of a revised site plan reallocating several residential units which were located closest to the District ' s holdings and the resolution of appropriate road improvement standards between staff and the District . Mr. Barry commented on the revised site plan that had been submitted and a proposed additional unit and he advised of a letter dated November 10, 1992, from the applicant ' s representative suggesting proposed modifications to the conditions of approval . Mr. Barry advised that the Public Works Department had several proposed modifications to the road standard and improvement conditions approved by the Planning Commission, and he presented the staff recommendation that testimony be taken, and the project continued to December 8, 1992 for decision and adoption of findings and he requested that the Board accept his oral report, take testimony, provide appropriate direction to staff in preparing the final conditions of project approval and continue the project to December 8, 1992, for project decision and adoption of findings. The following persons presented testimony: Stuart Flashman, 5626 Ocean View Drive, Oakland, Director of East Bay Municipal Utility District (EBMUD) , commented on a letter he presented from the District, and he commented on issues including land use planning and water systems planning, and he urged the Board to reconsider moving forward with this proposal and come to joint discussions with East Bay Municipal Utility District about coordination of respective planning concerns; Jim Blickenstaff, representing Preserve Area Ridgelands Committee, commented on the issue of water supply and the drought situation and he suggested that the Board postpone a Local Agency Formation Commission (LAFCO) decision on the matter until there is a dialog with EBMUD. Mark Armstrong, Gagen, McCoy, McMahon and Armstrong, representing HCV Pacific Partners and Jim and Nancy Wiedemann, presented proposed modifications to conditions of approval for the project, the East Bay Regional Park District proposed conditions, and the Public Works proposed modifications. Mr. Barry advised the Board that Mr. Armstrong had been provided with a copy of the subdivision indemnification approval condition and he proposed as an addendum to the staff report that this be added to the project . Mr. Armstrong expressed that there was no objection and continued with proposed modifications to the conditions. Maurice Shiu, Public Works Department, commented on a change to Section 3G to read 12 .5 percent and expressed agreement with the proposed changes. Bob Doyle, Assistant Manager, East Bay Regional Parks District, commented on the open space issues . Supervisor Schroder expressed appreciation to Mr. Doyle for his efforts. Mr. Armstrong commented on a revised regional trail map dated November 17, 1992 . Supervisor Schroder recommended a continuance and insertion of the conditions of approval that were agreed to by the Public Works Department and inclusion of the agreements that the applicant and the East Bay Regional Parks District have concluded and that the statement that this is not precedent setting by not requiring dedication of land. Supervisor McPeak clarified that the action was to continue the matter to December 8, 1992, direct that the proposed conditions, information, corrected maps, and the recognition of unique circumstance with respect to open space be included in the documents to be prepared and that the opportunity would be provided for comment only on the changed conditions. Mr. Barry clarified that the Chair' s summation of direction indicated the Board' s intent to modify the conditions as had been discussed today. Supervisor Torlakson seconded the motion. Victor Westman, County Counsel, clarified that implicit in the motion was to allow testimony on the proposed findings on the continued hearing date. Supervisor Schroder concurred. Supervisors Torlakson and McPeak commented on the issue of water service and Supervisor McPeak requested that with no objection from the Board that staff be requested to write in response to Mr. Flashman' s invitation to enter into a discussion with EBMUD on water service to areas within our urban limit line but outside EBMUD service boundary. IT IS BY THE BOARD ORDERED that for purposes of receiving testimony on revised conditions and findings, the hearing on the Weidemann Ranch Residential Project, including rezoning request 2947-RZ, Preliminary Development Plan 3005-91, Subdivision 7575, Subdivision 7578, and Agricultural Preserve Cancellations, is CONTINUED to December 8, 1992, at 2 P.M; the Community Development Department staff is DIRECTED to prepare the appropriate documentation for the project, including the modifications discussed and agreed upon, for Board consideration on December 8, 1992 ; and the Community Development Department staff is REQUESTED to write, on behalf of the Board of Supervisors, to Mr. Stuart Flashman of the East Bay Municipal Utility District in response to Mr. Flashman' s invitation to discuss water service to areas within the Urban Limit Line but outside of the EBMUD boundary.
