THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on November 17, 1992 by the following vote :
AYES : Supervisors Powers, Fanden, Torlakson and McPeak
NOES : Supervisor Schroder
ABSENT: None
ABSTAIN: None

SUBJECT: Decision on the Recommendation of the San Ramon Valley
Regional Planning Commission on Black Oak Estates,
Diablo/Blackhawk area.
On November 3 , 1992, the Board of Supervisors continued to
this date the decision on the recommendation of the San Ramon
Valley Regional Planning Commission on the request of Bryan and
Murphy Associates (applicant) and Black Oak Estates (owner) to
rezone land (2884-RZ) , for final development plan approval (DP
3004-90 , and for vesting tentative map approval (Subdivision
7462) in the Diablo/Blackhawk area.
Dennis Barry, Community Development Department, presented
the staff report and commented that the applicant has submitted
proposed draft findings and modified plan last Thursday which the
department has not had the chance to review and he recommended
continuing the decision to November 24, 1992 , to allow staff the
time to do so. Mr. Barry also commented that the applicant had
been notified of the proposed indemnification condition and they
seemed agreeable to it .
Supervisor Schroder moved to continue this matter to
November 24 , 1992, and request staff to meet with the interested
parties .
Supervisor McPeak requested clarification on the issue of
the two lots and the open space configuration and whether the two
lots can be transferred.
Mr. Barry commented that the proposed findings did include
the two lots and he commented further on the movement of the two
lots or deleting the two lots which the developer would not
accept .
Supervisor Torlakson advised that he strongly felt the two
lots should be eliminated.
Supervisor Fanden indicated support for Supervisor
Torlakson' s comments .
Supervisor Powers concurred.
Supervisor Schroder spoke in support of retaining the two
lots .
Supervisor McPeak advised that the language for the lots
being removed should be prepared as well as the findings and the
recommendations with the version of the two lots remaining since
the majority of the Board would prefer to have the option and the
language of having those two lots removed before them next week
for final action.
Supervisor Torlakson moved to declare the Board' s intent to
eliminate the lots .
Supervisor Fanden seconded the motion.
Supervisor Schroder commented that he hoped the Board would
have the opportunity to look at the two maps and make a
determination.
IT IS BY THE BOARD ORDERED that the decision on the request
of Bryan and Murphy Associates (applicant) and Black Oak Estates
(owner) to rezone land (2884-RZ) , on development plan (DP 3004-
90) and Subdivision 7462 is DEFERRED to November 24 , 1992 ; the
Board DECLARED ITS INTENT to remove two lots from the project;
and the Community Development Department is REQUESTED to prepare
the appropriate documentation for Board consideration on November
24 , 1992 .
