SUBJECT: PROCESS TO BE FOLLOWED. IN SELECTING A NEW SHERIFF-CORONER
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
In view of Sheriff-Coroner Richard Rainey' s impending resignation,
either:
1 . Appoint Assistant Sheriff (Chief Executive Assistant) Warren
Rupf as Sheriff-Coroner, effective December 7, 1992, or, if
this is not acceptable to the Board,
2 . Conduct an open recruitment for the position of Sheriff-
Coroner and then determine whom to appoint.
BACKGROUND:
As the Board is aware, Sheriff-Coroner Richard Rainey was elected
to the State Assembly on November 3, 1992 . He will be sworn in to
his new office on Monday, December 7, 1992 . He will, therefore,
resign his current position as Sheriff-Coroner of Contra Costa
County on December 6, 1992 .
Section '25304 of the Government Code provides that "The board of
supervisors shall fill by appointment all vacancies that occur in
any office filled by the appointment of the board and elective
county officers, except judge of the superior court and
supervisors . . . " . Therefore, as the Board has done on at least two
other occasions .in recent years with other elected Department
Heads, it falls to the Board of Supervisors to appoint a new
Sheriff-Coroner to serve out the balance of Sheriff Rainey' s
current term, which ends on the first Monday after the first
Tuesday in January 1995.

There are at least two processes, one of which the Board of
Supervisors may wish to consider following. The first would
involve appointing the Assistant Sheriff (Chief Executive
Assistant) , Warren Rupf, as Sheriff-Coroner. On the Board' s
Correspondence Calendar for November 17, 1992 are letters from:
1 . The Black Employees ' Association of Contra Costa County urging
the immediate appointment of Mr. Rupf as Sheriff-Coroner
without additional recruitment.
2 . The Black Deputies for Better Community Relations, urging the
immediate appointment of Mr. Rupf as Sheriff-Coroner.
3 . Assistant Sheriff Mitosinka, on behalf of all of the managers
in the Sheriff ' s Department, urging the immediate appointment
of Mr. Rupf as Sheriff-Coroner.
4 . The President of the Deputy Sheriff 's Association, addressed
to Mr. Rupf,. indicating that they would encourage his
appointment as Sheriff-Coroner.
The other process would involve an open recruitment of candidates,
much as was done with the selection of the District Attorney and
the County Clerk-Recorder. Applications would be screened by the
Board of Supervisors, if necessary, in order to reduce the pool to
a manageable number of candidates . This reduced pool of candidates
would then be interviewed by the full Board and a selection made
from among those candidates who have been interviewed.
Either process is consistent with State law. Neither process is
necessarily preferable. Particularly if an open recruitment
process is to be undertaken, it would be well to undertake the
process immediately, since Sheriff Rainey will be leaving office in
three weeks and such a process typically takes from a number of
weeks to several months to complete.
