MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: November 17, 1992 SUBJECT: Approving Empire Avenue Bridge Replacement Project, Oakley Area. Project No. 0662-6134017-91, CP # 92-69. Specific Request(s) or Recommendation(s) & Background & Justification I. RECOMMENDED ACTION: APPROVE Project, and FIND, on the basis of the initial study and all comments received, that there is no substantial evidence that the project will have a significant effect on the environment, ADOPT the Negative Declaration in compliance with the California Environmental Quality Act, and DIRECT the Public Works Director to begin right of way acquisition and to prepare contract plans and specifications for construction. DIRECT the Director of Community Development to file a Notice of Determination and a Certificate of Fee Exemption: De Minimis Impact Finding with the County Clerk. DIRECT the Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk. 11. FINANCIAL IMPACT: The estimated project cost is $1,600,000, funded by Oakley/North Brentwood Area of Benefit, (90%), and Senate Bill 300, State Transportation Development Act Funds (10%). REASONS FOR RECOMMENDATION/BACKGROUND: The proposed project involves the removal of an existing substandard two lane bridge and installation of a 96-foot wide by 45-foot long bridge where Empire Avenue crosses the Contra Costa Canal. To provide the required 2'freeboard across the canal, the new bridge and the intersection of Laurel Road and Empire Avenue will be raised. The vertical grade change and design speed improvements will require reconstruction of Laurel Road approximately 800 feet on either side of Empire Avenue. This project is the second phase of widening Empire Avenue to accommodate four lanes of through traffic. Phase 1, which widened Empire Avenue to ultimate width from Bedford Lane to the existing bridge, was completed last year. The project has been determined to be in compliance with the General Plan. A Negative Declaration of environmental significance pertaining to this project was published on October 7, 1992, with no protest, and the Board has considered the Negative Declaration together with all comments received during the public review period. This project has been found to be de minimis in its effect on the environment and is exempt from the $1,250.00 Fish and Game filing fee. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay of design and construction and may jeopardize funding.
