Cisterman, Director of Personnel SUBJECT: Retirement Association Membership Withdrawal by Temporary Reduction in Position Hours There has been an increasing pressure on the County to reduce individual employee's position hours to less than 20/40 and the next day to increase those hours to 20/40 or greater (back to the original position hours) as a means of allowing the employee to terminate membership in the Contra Costa county Employees' Retirement Association and withdraw their retirement contributions. While the County does not endorse this approach, it has become difficult to separate those employees with hardships which may warrant this action from those who simply wish to access a sum of money. Based on our experiences, we are drafting a policy to apply in making such decisions, a procedure to follow with all such requests, and forms to gather the information needed to ensure that individual employees who are requesting such action understand the short and long-term impact of their Retirement Association withdrawal, and to hold the County harmless in any such action taken. It is our proposal that the criteria for Retirement Association withdrawal via an individual Temporary Reduction in Position Hours meet the criteria similar to those for "Emergency Withdrawals" of Deferred Compensation, and that delegation be made to "the County Administrator or his designee" to "determine whether the conditions for an emergency withdrawal are met". Finally, for those requests which are approved, we recommend that the P300-Position Adjustment Request be initiated by the Personnel Department, rather than by the operating department, and that the County Administrator or his designee be delegated authority to approve such P300's without placing them in the Agenda for Board. Because there are several P300's now pending to reduce position hours for this purpose, and the affected individuals have had expectations that they would be approved routinely, we recommend that the Board approve the P300 for this purpose on the November 17, 1992, agenda, and that P300 actions for this purpose currently pending either in the Personnel Department or County Administrator's Office likewise be processed without further review. The policy and procedure we are proposing for this purpose will be finalized within the next several weeks and brought to the Board for its approval.
