SUBJECT: APPOINTMENT TO THE PRIVATE INDUSTRY COUNCIL AND RELATED
ACTIONS
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Rescind the appointment -of Jay Ripley to the business
representative vacancy on the Private Industry Council since
his employer is not a private-for-profit firm, but a private
non-profit firm.
2 . Appoint Gilbert A. Fitzgerald, Supervisor of Business Skills
Training, Chevron, U.S.A. , 6001 Bollinger Canyon Road, San
Ramon, CA 94526 to the business representative vacancy
created by Fred Gaul ' s resignation and Mr. Ripley' s inability
to serve in this position, to complete the unexpired term
ending September 30, 1993 .
3 . Remove as a referral to our Committee the Education vacancy
which has now been filled by the appointment of Dr. Helen
Spencer- to this vacancy.
BACKGROUND:
See attached correspondence from Arthur C. Miner, Executive
Director, Private Industry Council .
Our Committee has carefully reviewed the recommendation of staff
and the qualifications of the nominated candidate, as well as the
distribution and balance of the PIC. Based on this review, we
believe that the above recommendation will provide the best
possible balance to the PIC, and we urge the Board of Supervisors
to approve our recommendations .

VBJ LT: PIC APPOINTMENT
The Board needs to make one backfill appointment to the PIC for a business position
whose term expires on 9/30/93. This vacancy is as a result of the resignation of
Fred Gaul; his original replacement was precluded from accepting a PIC appointment
when it was ascertained that his employer, LDS Employment Services, was actually
a nonprofit rather than private for profit entity. Technically, the federal
regulations require a business representative to be from the private for profit
sector; Mr. Ripley now wishes to be considered for a community board organization
seat when a vacancy becomes available. The PIC consists of 20 members of the
following composition:
Business 12 Community Based Organization 1
Education 2 Economic Development 1
Labor 2 Public Employment Service 1
Rehabilitation 1
The JTPA legislation require the Board make its business appointments from among
individuals nominated from a master list which, for us, is coordinated by the Walnut
Creek Chamber of Commerce. The composition of the PIC is subject to review by the
Governor, who periodically certifies that our PIC is consistent with Federal and State
legislation. State legislation requires PIC vacancies to be filled by the Board within
60 days.
Attached is a list of nominees. After review, the PIC Chair and Executive Committee
request the Board to specifically consider Gilbert Fitzgerald, Business Skills
Training Supervisor with Chevron on Bollinger Canyon Road. His appointment
would balance the PIC business representatives at 50/50 male/female. His expertise
would be particularly important in assessing business skills training programs, a
major occupational area for this SDAs labor market. His appointment would balance
the PIC business representatives at 50/50 large/small business. The Executive
Committee is particularly interested in having Chevron represented on the PIC,
Chevron has been a long term contributor to our Summer Youth Program and there
Is a desire to strengthen if not cement this relationship.
