HomeMy WebLinkAboutMINUTES - 11031992 - D.1 � l BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY Adopted this order on November 3 , 1992 by the following vote : AYES: Supervisors Powers, Schroder, Torlakson and McPeak NOES : None ABSENT: Supervisor Fanden ABSTAIN: None ------------------------------------=------------------------- -------------------------------------------------------------- SUBJECT: Decision on the Recommendation of the San Ramon Valley Regional Planning Commission on Black Oak Estates, Diablo/Blackhawk area. On October 6, 1992, the Board of Supervisors continued to this time the decision on the recommendation of the San Ramon Valley Regional Planning Commission on the request of Bryan and Murphy Associates (applicant) and Black Oak Estates (owner) to rezone land (2884-RZ) , for final development plan approval (DP 3004-90) , and for vesting tentative map approval (Subdivision 7462) in the Diablo/Blackhawk area. Dennis Barry, Community Development Department, commented on the revised map received from the applicant on November 2, 1992 . Mr. Barry advised that the Public Works Department had concluded a drainage study in the area and that it could be included in the final conditions of approval, and he recommended that the Board declare its intent to approve the project and direct staff to come back with final conditions of approval and findings and find the Environmental Impact Report prepared for the General Plan Amendment adequate for the project . Supervisor Schroder expressed agreement with deferring the final decision to November 17, 1992 , to resolve issues including grading and drainage . Mitch Avalon, Public Works Department, commented on the drainage survey and the existing drainage patterns in the area. Mr. Avalon also commented on the drainage proposals . Supervisor Schroder moved to accept the Environmental Impact Report documentation and to declare the Board' s intent to approve the rezoning, development plan and vesting map and introduce the ordinance and intent to adopt findings and mitigation monitoring program. Supervisor Torlakson seconded the motion and he requested clarification on the resolution of the concerns of Save Mt . Diablo and the two lots . Robert Drake, Community Development Department, commented on the two alternative site plans prepared by the applicant . Seth Adams, representing Save Mt . Diablo, expressed no objection to the lots being moved. Supervisor Torlakson moved an amendment to the main motion to relocate the lots but keep that contiguous open space area and less intrusion on the stream channel . Supervisor Powers seconded the amendment to the main motion. Supervisor Schroder requested that the staff, the developer and the architect work together to determine the effect on the project of moving the two lots into another location and to have that information back in two weeks . Supervisor McPeak requested inclusion in the motion of direction to the staff and the applicant to place a marker on a tree on the top of the knoll in honor of the memory of Dan and Barbara Reed. IT IS BY THE BOARD ORDERED that the 1988 Athenian School General Plan Amendment Environmental Impact Report is ACCEPTED as the environmental documentation for this project and the decision on the request of Bryan and Murphy Associates (applicant) and Black Oak Estates (owner) to rezone land in the Diablo/Blackhawk area , and final development plan and subdivision map is DEFERRED to November 17, 1992, at 10 :45 a.m. ; and the Board hereby DECLARES ITS INTENT to approve the project and the Community Development Department is DIRECTED to prepare appropriate documentation for Board consideration on November 17, 1992 .
