SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACW.,ROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
a) Accept this report which discusses current levels of mandatory subscription enforcement.
b) Direct the Health Services Department to work with the County Administrator,County Counsel and Community
Development Department to develop a proposed revised mandatory subscription policy, ordinance and cost
effective enforcement program.

III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
This report responds to a Board of Supervisors inquiry regarding enforcement of the Mandatory Subscription Ordinance
referred to in the August 11, 1992 board order dealing with Interim Rate Adjustments and to subsequent inquiries by
the County Administrators Office.
The current enforcement program responds on a complaint basis to nuisances associated with the illegal disposal or
accumulation of solid waste. The investigation of these complaints include an evaluation of relative hazards and the
protection of public health. In many instances, the person is notified of the requirement for mandatory subscription.
Since January Health Services Department staff have responded to 1,129 complaints. Of those 80% were voluntarily
abated. The remaining 20% required a Health Officer abatement order.
According to counsel, one purpose of the 1985 mandatory subscription ordinance was to direct abatement at those
properties creating a nuisance or potential health problem. Our current level of enforcement is adequate for these
instances. If it is the decision of the Board to pursue an enforcement program for mandatory subscription, compelling
all non-subscribers in the unincorporated area (or portion thereof) to subscribe, then of course the Health Services
Department will draft such a policy for the Board's consideration.
To establish and implement such a policy,a mechanism for funding the program would have to be developed,particularly
for the pre-payment of mandatory subscription service. To minimize impacts, revisions of Chapter 418-6 and involved
collector franchises may be required to re-direct responsibilities to the collector. These could include: 1) continuous
collection service for all dwellings regardless of subscription status, 2) restrictions on collectors to prevent termination
of services for non-payment of bills, 3) collector's responsibility for sending some mandatory subscription notifications,
4) establish pre-payment of collection services with a disbursement of funds only after a tax assessment or lien has been
collected, 5) terminate all exemptions except for those persons residing outside a service area, and 6) initiate mini-can,
low-income homeowner and senior rates.
