BRAGDON ' f 4 Contra DIRECTOR OF COMMUNITY DEVELOPMENT Costa DATE: OCTOBER 27, 1992 County SUBJECT: ACCEPT PUBLIC COMMENT ON THE DRAFT COUNTYWIDE INTEGRATED WASTE MANAGEMENT PLAN AND SET NOVEMBER 24, 1992 FOR FINAL ACTION SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Accept Public Comment on the Draft Countywide Integrated Waste Management Plan (CoIWMP) and accept written comments through November 6, 1992 at 5: 00 p.m. ; Close Public Hearing; and, Direct staff to review all oral and written comments received on the Draft CoIWMP and prepare a staff report recommending appropriate changes to the Draft CoIWMP for Board action on November 24, 1992 . FISCAL IMPACT No impact to the General Fund. The AB 939 Tipping Fee and the Resource Recovery Fees cover the costs for preparation, circulation, and completion of the Countywide Integrated Waste Management Plan. Failure to meet the mandates of AB 939, particularly failure to meet the mandated waste diversion goals, can result in a $10, 000 per day fine being levied against local jurisdictions. BACKGROUND/REASONS FOR RECOMMENDATIONS The California Integrated Waste Management Act (AB 939) enacted in 1989 requires all California cities and counties to prepare both individual jurisdictional plans and. a countywide plan for the diversion and disposal of solid waste and household hazardous waste. Under AB 939, the County is responsible for the preparation of the plan and the Countywide Siting Element. Louise Aiello presented an oral report and reviewed the Contra Costa Integrated Waste Management Task Force's recommended changes to the draft County Integrated Waste Management Plan. The following persons appeared and gave testimony: Rosemary Corbin, Chair of the AB 939 Task Force; Avon Wilson, Contra Costa Solid Waste Authority; Robert Grinstead, 2153 LaSalle Drive, Walnut Creek; and Bill Davis, West Contra Costa Integrated Waste Management Authority. In addition, the Chair asked that the record include recognition of the staff who worked on the AB 939 Program/CoIWMP-- Louise Aiello, Belinda Smith, Robin Bedell-Waite and Lillian Fujii --and the efforts to assure review of the CoIWMP throughout the County. The Chair also acknowledged Julie Fisher for the County Recycling Guide. Copies were distributed to all cities and available in all County Libraries. On October 21", the AB 939 Local Task Force reviewed the Draft CoIWMP and made recommendations for changes as noted in attachment. LA:gms 939w:\bo\CoIWMP.hig A :�R CONTRA COSTA INTEGRATED WASTE MANAGEMENT TASK FORCE RECOMMENDED CHANGES TO DRAFT COIWMP 1. Adopt the solid waste management goals currently listed as those of the County General Plan as AB 939 Task Force goals, and add language recommending that cities use these goals for solid waste planning in their City General Plans. [Prior to AB 939 cities did not have any reason to include solid waste management planning in their General Plans; however, as cities pursue planning for material recovery, drop-off/buy centers, and so forth City General Plans will need to cover solid waste management planning matters. ] a. Modify the approach/language of the entire Draft CoIWMP to reflect its countywide nature. 2. Modify the Significant Issues section as follows-- a. change the discussion for administrative structure to provide that the Public Managers will, within one year, assess and recommend to the cities and the County an appropriate solid waste management administrative structure from among three possible structures-- +the Contra Costa Solid Waste Authority including consideration of roles and relationships of subregional solid waste authorities +a formal coordinating body established from among subregional solid waste authorities/entities +a combination of the above b. add a discussion of recent Court Decisions and State Legislative actions [AB 2092, AB 2494, and AB 3001] which need further consideration to determine the impacts on our local solid waste management programs. C. add, under discussion of the subregional facilities, two related issues 1. a discussion of the need to further assess mixed waste processing 2. a discussion of the need to monitor and assess the continuing feasibility of curbside collection of recyclables in relation to material recovery facility operations. d. add a discussion of the need to develop a financing analysis which provides for consistency and allows overall program cost comparisons on a countywide basis e. add within the financing analyis discussion language which provides that increases to the Fees for implementation of AB 939 related-programs can be increased only for a specific jurisdiction wanting the increase or will require the concurrence of the jurisdictions participating in a multi-jurisdictional program for which the increase is needed. 3. Add' language into the Siting Element which allows for the export of solid waste and including a study of the economic feasibility of export and its impact on any previous plans, assurance that a receiving county' s CoIWMP and capacity can handle the exported waste, and a requirement to ref lect such export in the first SRRE and CoIWMP revision. 4. Include in the HHW Section [Part III] the agreement for the Countywide Household Hazardous Waste Collection Program. al/a:staffrec.939
