RESOLUTION NO. 92/106
SUBJECT: IN THE MATTER OF AUTHORIZING A SEPARATE TRUST FUND
FOR THE NORTH RICHMOND AREA OF THE WEST COUNTY
REGION OF THE COUNTYWIDE AREA OF BENEFIT.
The Board of Supervisors of Contra Costa County RESOLVES as follows:
The Board FINDS and DETERMINES that:
Government Code Section 66484 and Division 913, Title 9, of the Contra Costa County
Ordinance Code provides for assessing and collecting fees for bridge and/or major
thoroughfare construction within a designated area of benefit as a condition of approval of
a final subdivision map or as a condition of issuing a building permit; and
On March 15, 1988, the Board first adopted the Countywide Area of Benefit (AOB) by
Ordinance No. 88-27. The Ordinance applies to the unincorporated areas of the County.
The Countywide AOB was divided into seven regions, some of which were further divided
into subareas. One of the seven regions is the West County Area. The West County is
further divided into three subareas,Hercules/Rodeo/Crockett,West County and Kensington.
The fees for these areas are currently $1684 per single family unit, $1319 per multi family
unit, $2.63 per square foot of office, $1.15 per gross square foot of industrial and $4.12 per
gross square of commercial.
The Public Works Director and the Director of Community Development are currently
reviewing the North Richmond area to determine needed road improvements due to
expected new development. A DevelopmentProgram Report will be prepared and
presented to the Board at a later date to consider creation of a separate AOB for the
North Richmond Area. This process is expected to take one year to complete and there are
developments which will receive building permits and pay fees prior to creation of the
separate AOB. In order to capture the funds from these developments for the North
Richmond Area instead of the general West County Subarea Fund we recommend that the
Board authorize the creation of a separate trust fund for the North Richmond Area. The
boundaries of the area would coincide with the boundaries of the Redevelopment area, as
described in Exhibit A. The fee amounts collected would remain the same as stated above
until a separate AOB is.created.
The Board hereby DIRECTS the Public Works Director and the Director of Community
Development to prepare a Development Program report and other necessary documents for
the North Richmond Area and to present it to the Board for consideration.
The Board DIRECTS the Auditor/Controller to establish a separate trust fund for the North
Richmond Area and AUTHORIZES the Public Works Director to transfer fees collected
in the North Richmond area by the West County AOB into this trust fund.
