FINANCIAL IMPACT: The agreement provides for a scheduled repayment of $20, 000. 00 to the fire district reserve fund and settles fire district financial liability for undergrounding charges. REASONS FOR RECOMMENDATION/BACKGROUND: The recommended action will insure prompt repayment of $20, 000. 00 by the Town of Moraga to the Moraga Fire Protection District and settle charges for utility undergrounding project. County/ Administrator ATTESTED Moraga Fare Protection Dist PHIL BATCHELOR,CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR BY DEPUTY M382 (10/88) In December of 1985, Moraga Fire Protection District advanced $20, 000. 00 in capital outlay. reserve funds to the Town of Moraga to upgrade traffic signal lights in the Rheem area. This arrangement allowed installation of Opticom traffic control systems which are used by fire district vehicles for emergency response. These funds were to be repaid by the Town from traffic mitigation fees from future development in the Rheem area of Moraga. Significant development has not occurred in the Rheem area as expected, and as a result, traffic mitigation revenues have been inadequate to finance repayment of funds advanced by the fire district to the Town of Moraga. The settlement agreement requires the Town of Moraga to immediately begin a scheduled repayment of the $20, 000. 00 to the Moraga Fire Protection District. In May of 1992 the Town of Moraga completed a comprehensive utility undergrounding project, a portion of which passed in front of and provided benefit to Moraga Fire Station #41 and Headquarters Building. The settlement agreement recognizes the fire districts payment of $18, 750. 00 as its full share of the costs of the undergrounding project and precludes the Town of Moraga from levying a lien on fire district property for the project. CONSEQUENCES OF NEGATIVE ACTION: Inability to insure prompt repayment of reserve funds to the Moraga Fire Protection District by the Town of Moraga. Possible lien on fire district property for additional utility undegrounding project costs.
