t FIREARMS - DISCHARGE RESTRICTIONS
ORDINANCE NO. 92- 72
The Contra Costa County Board of Supervisors ordains as
} follows (omitting the parenthetical footnotes from the official
text of the enacted or amended provision of the County Ordinance
j Code)
SECTION I. SUMMARY.
This ordinance amends Section 44-4 .004 of Chapter 44-4 of
- the County Ordinance Code to prohibit discharging a firearm not
only in any public place but also adjacent to or in the direction
of any public place as well as in any private place located in a
district zoned residential or commercial.
SECTION II . Section 44-4004 of the County Ordinance Code is
amended to read:
44-4 . 004 Firearms - Discharge restrictions - Exceptions .
(a) No person shall discharge any firearm in any public
place or adjacent to or in the direction of any public place.
(b) No person shall discharge any firearm in any private
place located in a district zoned residential or commercial.
(c) Subsections (a) and (b) shall not apply to:
(1) The discharge of firearms otherwise authorized by law;
(2) Any of the persons listed in Penal Code Section 12031(b) .
SECTION III . SEVERABILITY. The Board declares that, if any part
of this ordinance is invalidated, it intends the remainder to
remain valid and effective and that it would have passed the
remainder even without the invalidated part or parts.
SECTION IV. EFFECTIVE DATE. This ordinance becomes effective 30
days after passage, and within 15 days after passage shall be
published once with the names of supervisors voting for and
against it in the Contra Costa Times , a newspaper
published in this County.
