Request a meeting of County Supervisorial Board members with EBMUD Board members to initiate discussion and communicate concerns on annexation issues prior to EBMUD adoption of an interim annexation policy. 2 . Request EBMUD to provide additional information to the Water Committee before acting on EBMUD's request for support of their fisheries management program, as part of the water rights hearings before the State Water Resources Control Board. BACKGROUNDIREASONS FOR RECOMMENDATIONS 1. During the September 28,1992 meeting, the Water Committee was advised that the EBMUD Board would be considering an interim annexation policy the following day, during their regularly scheduled Board meeting. Given the importance of the issue, and the need for all concerns to be addressed prior to adoption of policy, the Water Committee -recommends that some communication take place between the respective Boards of Supervisors. Acting on an urgency basis, and with the concurrence of County Counsel, the Water Committee authored a letter to the EBMUD Board requesting that some discussion take .place. Continued - Page Two On September 29, 1992, the EBMUD Board read the County request into the record. The EBMUD Board agreed that some dialogue would be in order. The EBMUD Board has directed staff to go ahead with an initial study to determine what documentation would be necessary under CEQA for this annexation policy. Water Committee members had arranged to speak with EBMUD Board members and staff regarding the fishery issue, and the EBMUD Board agreed that some initial discussion on annexation could take place at this time. The EBMUD Board also indicated that, given the import of the fishery matter, a follow-up meeting would be necessary. 2 . On August 21, 1992 , the Board received a request from EBMUD for support of the Lower Mokelumne River Management Plan (LMRMP) , as part of water rights hearings before the State Water Resources Control Board in November, 1992 . The LMRMP is a component of a comprehensive Water Supply Management Program, in which EBMUD is evaluating their need for water over the next 30 years. After extensive screening, several composite programs have been identified, and will be included in detail in the Environmental Impact Statement/Report to be released in December 1992 . The LMRMP provides an additional increment of water for fishery use which EBMUD feels addresses the problem of additional water for fishery management, while preserving water supplies for urban use as well. The plan commits EBMUD to modified reservoir operations, additional water releases, hatchery structural and operational improvements, participation in other non-flow enhancement and continuing monitoring and research. The plan does not provide optimum flows for fish in all years, but rather advocates shortages for fish and urban users in unavoidable water shortages. The Department of Fish and Game has proposed a plan which allocates a great deal of additional water for fishery use, essentially running the EBMUD system dry in some years. The Water Committee requests some additional information from EBMUD, particularly in regard to EBMUD's proportion of water use, versus proportionate proposed mitigation or solutions which address resultant impacts to fisheries.
