RECOMMENDATIONS
1. Direct the Community Development Department, County
Administrator Office and County Counsel to provide reports to
the Water Committee providing additional detail to aid in
determination of potential ship channel local sponsorship,
joint powers agreement, or other means of assessment
methodology for ship channel maintenance dredging for the east
county area.
2 . Accept report and comments regarding the San Francisco Estuary
Project Comprehensive Conservation and Management Plan.
FISCAL IMPACT
No funding is required at this time. Future potential County
assumption of local sponsorship or other assessment responsibility
is contingent upon local industry payment of associated costs.
BACKGROUND/REASONS FOR RECOMMENDATIONS
1. In accordance with their alleged local sponsorship
responsibilities, in June of 1992 the Stockton Port District
declared their intention to form an assessment district to
acquire funding for dredge disposal operations. Industry
located within Contra Costa County has been included in the
proposed assessment district. Industry has a great deal of

concern with the assessment district proposal and as a result,
several companies hired legal representation, and filed
protests. Although the Port later agreed to accept a higher
proportion of costs, involved County industry has indicated a
unanimous preference for assessments to come from Contra Costa
County rather than San Joaquin.
At the September 14, 1992 hearing, staff indicated to the Port
District that the County would give consideration to assuming
assessment district responsibility and potential for local
sponsorship activity for the east County portion of the
channel, (as indicated in Board Report 9/3/92) . In addition,
a follow-up letter from Supervisor Torlakson was provided at
the hearing, providing further impetus for a favorable Port
response. The Port replied that this portion of the channel
is somewhat of a burden as it is located some distance from
the Port, and they are willing to give the County 6 months to
accomplish local sponsorship, (with the 90-day progress
report) as requested, prior to the above-mentioned assessments
going into effect.
The Water Committee heard from a representative of the
Stockton Port District and several local industry
representatives during their September 28, 1992 meeting. The
Water Committee indicated that more information is necessary
prior to making a recommendation on the best course of action.
The Water Committee requested that additional information
include the legal aspects and environmental considerations of
taking on local sponsorship or joint powers responsibility.
In addition, information on costs, funding mechanisms,
assessment methodologies as proposed by the Port, local
industry channel use percentages and distance considerations
were requested.
2 . In accordance with the Board report (WC 1) of September 22,
1992 , the Water Committee reviewed comments on the San
Francisco Estuary Project Comprehensive Conservation and
Management Plan, and forwarded these comments to the Estuary
Project. A summary of background and comments are as follows.
The Comprehensive Conservation and Development Plan summarizes
significant study which has taken place by the Estuary Project
(as well as other entities) , in a variety of identified
problem areas. Areas of concern include wildlife
preservation, wetlands management, water use (conservation,
flows) , pollution (both point and non-point source) , dredging
and waterway modification, and land use. The CCMP recognizes
the import of a healthy resource to a healthy economy, and
recommends plans and programs to address threats to estuarine
resources.
The County General Plan includes strong policy in regard to
growth management, and wetlands preservation. In addition,
the program currently in place to address non-point source
pollution, coupled with existing policy regarding water
quality and conservation of resources indicates County
consistency (to some degree) , with many of the CCMP subject
areas where subsequent regulation could impact the County.
County comments address areas in which programs differ, as
well as program implementation, particularly for those
programs which go above and beyond current County policy.
Comments included questions as to local agency authority and
ability to work with other (assigned) entities as regards
these programs, as well as funding and other considerations.
