All 12 design contractors have been halted including the Atlas Interchange at Hilltop. 2. $10.5 million contract to widen median from Carlson to Dam Road stopped. 3. $14 million contract for the construction of HOV lanes in Alameda County 4. Loss of a significant source of job opportunities and a much needed economic boost for the East Bay. Project Elements to be Held Up or Totally Lost if Preliminary Injunction Granted on 10-30-92: 1. Hercules/4 Project of $9 million may cause Hercules City to pay back$400,000 to Caltrans. 2. Vacaville-Fairfield BART express bus stopped - $120,000 3. AC Transit San Pablo Ave. to EI Cerrito BART stopped - $380,000 4. AC Transit EI Sobrante - Richmond to San Francisco bus stopped - $90,000 5. Other Transit programs in the attached TMP chart would not be implemented. 6. San Pablo Ave. City projects in the attached Parallel Route list would not be implemented. All that are under design now must be stopped or City risks having to pay. Long Term Implications if Lawsuit is Successful: 1. $318,000,000.in funding for the project will be lost to the Bay Area and perhaps the state. 2. The funds will no be able to be converted into transit or any other type of funding for the region. 3. Loss of the transit and parallel route improvements already programmed and in some cases operation. History: This is a project which has been around for 14 years and is a federally funded interstate completion program,which is now under construction. The project has been changed several times in response to concerns by cities and community groups along the corridor. Caltrans formed an advisory committee approximately 5 years ago in order to seek input for communities along the highway . The committee commented on the project design and as a result the project was adjusted by Caltrans. The committee,along with Alameda and Contra Costa County Cities and transit operators, also worked with Caltrans to develop mitigation programs. The mitigation programs developed were parallel route improvements and transit programs designed to relieve congestion during highway construction. MTC most recently worked with Caltrans to make changes to the project, primarily to address concerns of the City of Berkeley, City of Albany,transit operators and environmental groups. Alternatives to Highway Improvements: Two years ago the I/S 80 Advisory Committee, in response to interest by its members to do a transit project instead of a highway project, investigated the possibility of a transfer of funds. Supervisor Powers worked with Caltrans to investigate what formally was called an interstate transfer of funds. The result was that Congress had eliminated the interstate transfer procedure. Moreover,there was little likelihood that new legislation would revive the transfer process as the Congress was working on a new transit and highway package (ISTEA ). Furthermore, it was clear from the funding and planning agencies (FHWA, CTC, Caltrans and MTC)that a delay could result in the loss of federal funding for the project. It was clear from our investigation that there were many Interstate Completion Projects that would absorb funding for the I/S 80 project if it did not go forward. Transportation Mitigation Programs: The I/S 80 project contains a substantial amount of funds ($14,900,000) dedicated to transit and ride sharing ($5.9 million), park and ride lots ($1.2 million), vehicle monitoring and motorist information ($3.8 million), public information ($1.9 million) and parallel route improvements$2.3 million) and in addition TMP funds of$3.5 million in San Pablo Ave. improvements in Richmond and San Pablo and several park and ride lots on I/S 80. Most of the transit projects support BART, AC Transit, Berkeley Trip -3- Answer Van, the Vallejo Ferry and RIDES ($7.136 million) are shown in attachment 1. While some of the projects have started (Feb./Mar., 92) and will be on-going for many years, the halting of the project will result, not only in stopping construction but the loss of the transit. likewise the funds for the purchase of park and ride lots shown in attachment 2 will also not go forward. In addition, the proposed parallel route improvements in the cities from Oakland to Rodeo described in attachment 3 will not go forward if the project is halted. Major Elements of Project: The main elements of the project through Alameda and Contra Costa Counties are: - Atlas Road Interchange at Hilltop-Pinole and HOV ramp, - A high occupancy lane to move carpools vans and buses, - A bus ramp at Cutting Blvd. to allow direct express bus access to the EI Cerrito Del Norte BART station, - Major safety improvements and rebuilding of 80/580 interchange at Albany, - The completion of the Knox (580) freeway,: - Miscellaneous safety improvements, over crossings and frontage roads, - Transit funding to mitigate construction traffic - Parallel Route improvements for San Pablo and other city streets. The contracts for the construction have been awarded. One contract for $10.5 million to rebuild the median between Carlson Blvd. to East of San Pablo Dam has been stopped due to a temporary restraining order. A second contract to Berkeley based O.C. Jones and Sons for$14 million has been awarded but not started. These contracts for construction and their attending jobs, local purchases and tax revenue will be held up pending further court proceeding. Caltrans estimates that the delays resulting from the lawsuit will cost $3 to $5 million. i The entire construction project,transit programs, parallel route improvements and other project elements total over$318,000,000 and is one of the few large construction projects in the East Bay. r -4- , i Things That Could be Done to Preserve the Project: f 1. Write letters to the Judge of the Alameda County Superior Court in the Case of Urban Ecology, et. al. vs. State of California, 2. Prepare a declaration to the court and submit it officially through your city of transit district or individually send it to Caltrans, 3. Like the Contra Costa Transportation Authority and other public agencies,file a Friend of the Court brief (Amicus Curie) with the Superior Court or ask your council to do so. 4. Consider joining me and other members of the I/S 80 Advisory Committee in a press conference next week (call me for date, time and location) to express your concerns on how the stopping of this project effects your community. 5. Call to local labor leaders, citizens and political leaders to join the effort. 6. Develop letters to send out to local newspapers for an editorial opportunity piece.
