SUBJECT: PROCESS TO BE USED TO FILL VACANCIES ON THE BOARD OF FIRE COMMISSIONERS OF THE CONTRA COSTA COUNTY FIRE PROTECTION DISTRICT SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATIONS : 1 . Direct the County Administrator to contact the Pleasant Hill City Council and the Concord City Council and request that they each supply the Board of Supervisors with the names of two or three individuals the City Council would nominate for membership on the Contra Costa County Fire Protection District Board of Fire Commissioners . 2 . In the above communication with the City Councils, direct the County Administrator to point out that the Board of Fire Commissioners is advisory to the Board. of Supervisors and that the following criteria will govern the Board of Supervisors in making appointments to the Board of Fire Commissioners : A. The applicant 's knowledge of the Fire District and issues currently confronting the Fire District. B. Evidence of the applicant' s willingness to make the necessary time commitment to serve in this capacity. C. Indications of the applicant' s past involvement in issues confronting the Fire District. D. The extent of the applicant' s understanding of and concurrence with the Board of Supervisors ' position on the financing and delivery of fire services in the County. Direct the County Administrator to advertise the vacancy in the at-large seat on the Contra Costa County Fire Protection District Board of Fire Commissioners, indicating the advisory nature of the position and the above criteria which will be used in selecting an applicant for appointment and return all applications to the Internal Operations Committee for screening and a recommendation to the Board of Supervisors for appointment. BACKGROUND: On September 8, 1992, the Board of Supervisors received and referred to our Committee a letter from B. Palmer Riedel, Chairman of the Contra Costa County Fire Protection District Board of Fire Commissioners, asking that the Board of Supervisors fill two vacancies on the Commission. The Board will recall that the five seats on the Commission are allocated as follows : * One seat each to the four cities in the District with the highest assessed value, with the City Council having the right to nominate candidates for the Commission, but with the Board of Supervisors having the final decision as to who should be appointed. * One at-large seat, to be appointed at the sole discretion of the Board of Supervisors . This system has provided the cities of Concord, Walnut Creek and Lafayette each with a nominee. Historically, the fourth city seat belonged to the City of Martinez. However, several years ago, the City of Pleasant Hill pointed out their assessed value had exceeded that of the City of Martinez and that they, therefore, were entitled to the fourth city seat. In 1986, the Board of Supervisors gave the nomination for the fourth seat to the City of Pleasant Hill . The Board also, however, committed to filling the vacancy which existed at that time in the at-large seat with a nominee from the City of Martinez . The Board did not, apparently, intend that this at-large seat belong to Martinez indefinitely. A copy of Resolution 86/381 and a Board Order dated April 29, 1992 are attached for the Board's information. In response to this action, the City of Pleasant Hill nominated Mr. Al Gray, who was appointed by the Board of Supervisors to the "Pleasant Hill" seat. Mr. Gray died last year and the "Pleasant Hill" seat has remained vacant since that time. In addition, the City of Martinez nominated and the Board of Supervisors appointed Gary Hernandez to the "County-Martinez" seat on the Commission. Mr. Hernandez ' term of office expired December 31, 1991, hence Mr. Riedel 's reference to two vacancies on the Commission. In addition, the term of office of Mr. MacIntosh, the nominee of the City of Concord, expires December 31, 1992 . On September 28, 1992, our Committee considered how to proceed to fill these vacancies . We believe that the cities need to provide multiple nominations so that the Board of Supervisors has some choice in making an appointment. In addition, we find no indication that the Board of Supervisors even intended to delegate the County' s at-large seat to the City of Martinez indefinitely. There are significant unincorporated areas in the Fire District, plus the City of Clayton, which need to be considered in selecting a representative to the at-large seat, as well as the City of Martinez . We are, therefore, asking that the at-large seat be advertised throughout the Fire District and that the City of Pleasant Hill and the City of Concord be asked to provide multiple nominees for their respective seats, although they are welcome to rank order their nominations . -2- I .O. - 10 Our Committee will return to the Board with recommendations for appointments to these vacancies as soon as the application process has been completed. -3- THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 29, 1986 by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson, Powers NOES: None ASSENT. None ABSTAIN: None SUBJECT* Appointment of Contra costa County Fire Protection District RESOLUTION NO. 86/381 Commissioners. The Board of Supervisors of Contra Costa County Resolves That: 1. On February 24, 1986 this Board ordered that its staff prepare and provide it with a resolution reflecting its intent that the Board of Commissioners of the Contra Costa County Fire District consist of a representative from each of the four cities of the Fire district with the highest assessed valuation. 2. This Board Hereby Resolves that for the Contra• Costa County Fire Protection District it will appoint five fire commissioners by the following procedure: A. Four Commissioners. (1) The city council of each of the four cities with the greatest assessed valuation shall nominate one commissioner for consideration for appointment by the Board of Supervisors. . (2) Each other city included within the district shall be permitted to have an ex-officio representative attend the fire district commission meetings as an observer and without the power to vote. (3) when a new city is created and entitled to nominate a commissioner under the provisions of (a) above, the nomination shall be submitted immediately prior the expiration •o.f the term of office of the commissioner who is to be replaced (the commissioner from the city with the lowest assessed valuation taking into account the valuation of the new city which has become a part of the district) . (4) Pending the time that the new city may nominate a commissioner, it is entitled to have ex-officio representative in district commission meetings serving as provided in (b) above. B. One Commissioner. A fifth commissioner to be appointed by the Board as it deems appropriate. 3. The provisions of this resolution concerning the appoint- ment of fire commissioners for the Contra Costa County Fire Protection District prevail over and fully supersede any 'similar provisions contained in Resolution Nos. 67/5 and 69/181. Reaffirm the Board's support for a five-member Board of Fire commissioners. 2. Adopt the attached Resolution which continues a five-member Commission, with four of the seats to be held by the four cities in the District with the highest assessed valuation and which leaves one At-Large seat for appointment by the Board. 3. Reaffirm the' Board's intent to appoint to the current vacancy on the Commission a representative nominated by the Martinez City council. BACKGROUND: on March 25, 1986, the Board referred to our committee the issue of the size and composition of the Board of Fire Commissioners for Consolidated Fire District. There had been some confusion regarding the intent of our Committee's previous recommendation. Our Committee met with Chief Maxfield on April 28. Our Committee believes that a five-member Commission is appropriate for the Fire District and the current system of having the four cities with the highest assessed valuation have permanent seats on the Commission has worked well and should be continued. Our Committee also wishes to reaffirm the Board's previous intent to appoint to the fifth seat a representative nominated by the Martinez City Council.
