RECOMMENDATIONS
Deny the request to rezone the subject site from Agricultural
Preserve (A-4) to Single Family Residential (R-40) and General
Agricultural District (A-2) as per County Planning Commission
recommendation.
BACKGROUND/REASONS FOR RECOMMENDATIONS
This application was heard by the County Planning Commission on
June 30, 1992 . The site involves a 41. 48 acre property at the west
end of Alhambra Valley. At one time, the 'site had been subject to
a Williamson Act contract which expired in 1990. The applicants are
seeking to change the zoning to reflect allowable zoning under the
General Plan designations (Single Family Residential - Very Low and
Agricultural lands) . The request is to change the zoning from A-4
to R-40 and A-2 . The rezoning application is the only application
filed at this time (i.e. , not accompanied by a subdivision
application) .
The staff report indicates concerns with respect to availability of
adequate water supplies (the site is outside the City of Martinez
Water Service area and sphere of influence) ; and possible cookie-
cutter development of the site. The Staff recommendation to the
Commission was that the request for R-40 Zoning should a denied
and that the entire site be -rezoned to A-2 .

The rezoning request is opposed by the City of Martinez, Alhambra Valley
Improvement Association, East Bay Regional Park District and several neighbors.
Letters have been received from several neighbors indicating recent problems
with well water availability.
The Planning Commission unanimously voted to recommend to your Board denial
of the entire rezoning request (not just the R-40 portion) . The effect of
the Commission's action would be to leave the property zoned A-4 .
REVISED REZONING REOUEST
Following the Commission's action, staff received two letters from the appli-
cant dated July 9, 1992 indicating their willingness to allow for A-2 Zoning
only as had been recommended in the staff report to the Commission.
Both A-2 and A-4 Zoning can be found to conform with the General Plan desig-
nations for this site.

ADDENDUM TO ITEM H.9
OCTOBER 6, 1992
This is the time heretofore noticed for hearing on the recommendation of the
Contra Costa County Planning commission on the request (2910-RZ) of Timothy and
Gayle Cusick (;applicants and owners) to rezone 41.E acres from Agricultural Preserve
(A-4) to General Agricultural (A-2) (34.29 acres) and to Single Family Residential (R-
40) (6.6 acres) in the Martinez/Alhambra Valley area.
Dennis Barry Community Development Dept. presented the staff report.
The public hearing was opened and the following persons presented testimony:
Gayle Cusick, 5433 Alhambra Valley Road, Martinez;
Hal Olsen, 22 Wanda Way, Martinez, representing the Alhambra Valley
Improvement Association,
Mrs. Cusick spoke in rebuttal.
The public hearino was closed and on the recommendation of'Supervisor
Fanden, the above recommendation is APPIZOVED and the rezoning application 2910-
RZ for rezoning [rom Agricultural Preserve (A-4) to General Agricultural District (A-2)
is APPROVED, Ordinance No. 92-68, giving effect to the rezoning is INTRODUCED,
reading waived; and October 13, 1992, is set for adoption of same.
