Coirty DATE: 7 July 1992 SUBJECT: APPEAL of the County Planning Commission approval of Minor Subdivision #32-91 (Bruce Lindorf, Applic/Owner) by adjoin- ing property owners - Walnut Creek Area. (APN 180-180-010) ---------------------------------------------------------------------- SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the Environmental documentation prepared for this project as being complete and adequate. 2 . Deny the appeal of Yvonne Deatsch, et al. 3 . Approve the tentative map for MS 32-91 as recommended by the Planning Commission on May 26, 1992 meeting. 4. Approve the conditions as recommended by the Commission at the May 26, 1992 meeting. 5. Approve the findings contained in the resolution of the County Planning Commission as the basis for the Board's actions. BACKGROUND/REASONS FOR RECOMMENDATIONS The background for this project is reviewed in the May 26, 1992 staff report to the County Planning Commission. The Commission reviewed the appeal of the Zoning Administrator's approval by the applicant reducing the number of lots from four (4) to three (3) due to limited access, building height restrictions to reduce massing, design restrictions to ensure compatibility with the established neighborhood and a safety berm at the project's entrance. The Commission after taking testimony voted to approve the applica- tion for four lots with modified conditions. On June 5, 1992 , the adjacent property owners, Deatsch et al, appealed the Commission's decision to the Board. The Deatsch et al, appeal contains no information that as not available to the Commission. Philip Deatsch from the decision of the Contra Costa County Planning Commission Board of Appeals on the request of Bruce and Angie Lindorf (applicants and owners) for approval of a tentative map to divide approximately 2 . 86 acres into 4 parcels . Variances are requested for average lot width as follows : Parcel A-59 feet; Parcel D-89 feet (120 feet required) (MS 32-91) in the Walnut Creek area. Dennis Barry, Community Development Department, presented the staff report and a brief history of the proposed project and he commented on the staff recommendations . The following persons presented testimony: Bruce Lindorf, 1050 Scots Lane, Walnut Creek, applicant; Edward Shaffer, Norris and Norris, Richmond, Attorney representing Bruce and Angie Lindorf; Steve Passerine, 1038 Scots Lane, Walnut Creek; Mary Ann Passerine, 1038 Scots Lane, Walnut Creek; Sally Holcombe, 1036 Scots Lane, Walnut Creek, for herself and her husband; John Taglio, 1040 Scots Lane, Walnut Creek; Anthony Dattalo, 15 Christmas Court, Walnut Creek; Danny M. Russell, 16 Christmas Court, Walnut Creek; Tom Stewart., 16 Christmas Court, Walnut Creek. Edward Shaffer spoke in rebuttal . The public hearing was closed. Supervisor Schroder commented on the conditions of approval and on the character of the neighborhood and he recommended that Board members visit the area and observe the terrain and the neighborhood and he recommended that the decision on this matter be deferred for one week. Supervisor Fanden seconded the motion, requesting clarification on height limitation, and concurred that she would like to go out and look at the area. IT IS BY THE BOARD ORDERED that the decision is DEFERRED to October 13 , 1992, at 10 :45 a.m. on the appeal of Mr. and Mrs . Philip Deatsch et al from the decision of the Contra Costa County Planning Commission Board of Appeals on the request of Bruce and Angie Lindorf (applicants and owners) for approval of a tentative map (MS 32-91) to divide 2 . 86 acres into four parcels in the Walnut Creek area.
