HomeMy WebLinkAboutMINUTES - 10061992 - 2.7 r 2 .7 TO: BOARD OF SUPERVISORS 1 FROM: Phil Batchelor County Administrator DATE: October 6, 1992 SUBJECT: Meeting with Advisory Council on Equal Employment Opportunity, Associated General Contractors, and Interested Public Participants SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATION(S): The Advisory Council on Equal Employment Opportunity held a meeting to review the issues referred by the Board of Supervisors at its September 15, 1992 meeting, Those issues (attachment 1) were discussed by the Advisory Council, Associated General Contractors, Minority Contractors and other interested individuals. BACKGROUND/REASON(S) FOR RECOMMENDATIONS: It was the decision of the Advisory Council to recommend the following: 1. Request that the Board postpone making a decision on the MBE/WBE proposals for thirty to forty five days to give the Advisory Council an opportunity to further discuss with the Associated General Contractors, County staff, and other interested individuals the various enforcement, incentive, bonding recommendations, and "good faith effort" requirements presented to and by the Council. 2. Support staff's recommendation to lower the threshold level of the MBE/WBE program to the formal bid levels of $25,000 for Public Works contracts and $10,000 for General Services and flood control contracts. Adopt the County's 1989 definition of Hispanic that excludes Portuguese and European Spanish from the definition. The definition states: Hispanic: all persons having origins in Mexico, Puerto Rico, Cuba, Central or South America, regardless of race. 4. Consider re-establishing a Contract Compliance Specialist position in the Affirmative Action Office to assist in meeting the County's MBE/WBE goals. The Advisory Council has scheduled a special meeting for October 16, 1992 to continue its consideration of the MBE/WBE proposals. The Advisory Council's next regularly scheduled meeting is November 6, 1992 and intends to compile all recommendations for consideration by the Board of Supervisors at the time. 2 2.7 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUN'T'Y, CALIFORNIA Adopted this Order on October 6 , 1992 , by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson, McPeak NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------ SUBJECT: Report on Meeting with the Advisory Council on Equal Employment Opportunity, Associated General Contractors, and Interested Public Participants The Board received the report of the County Administrator transmitting the recommendations of the Advisory .Council (copy attached) . Clifford Tong, Small Business Connection, 1091A Orchard Road, Lafayette, spoke on the need to make sure that the Minority Business Enterprise/Women' s Business Enterprise Program is the right one for Contra Costa County. He requested the establishment of realistic goals for the bidding process and an enforcement policy to insure their attainment. IT IS BY THE BOARD ORDERED that this matter is continued to November 17 , 1992 , with a request to the Advisory Council to schedule additional meetings as may be required on the issues presented at the September 15 , 1992 Board meeting. Diablo Unitarian Universalist Church Children's Task Force. 1. 55 DEFERRED to September 22, 1992 at 10:45 a.m. decision on tentative map, conditions of approval and findings for Subdivision No. 7451, E1 Sobrante area. DETERMINATION ITEMS: Approved as listed except as noted below: 2.1 DECLARED intent to ratify and adopt on October 6, 1992, Minority and Women Business Enterprise Programs as proposed, subject to the following considerations and modifications: 1. Change "and" to "or" in Item C of the "good faith effort" requirements. 2. Consider increasing the threshold to which the construction program applies to at least $100,000. 3. Refer to the Internal Operations Committee, County Counsel, and the County Administrator consideration of a simplified program for those projects below the threshold. 4. Evaluate how to include Portuguese in the Hispanic definition of minority, and determine what data needs to be gathered to achieve this. 5. Review the "good faith effort" language to remove as much subjectivity as possible. 6. Work with The Associated General Contractors to evaluate the feasibility of a bonding program for M/WBE small business entities. 7. Refer this item to the Advisory Council on Equal Employment Opportunity, to be scheduled for its meeting of October 2, 1992, to obtain additional input, with comments to be returned to the Board on October 6, 1992. 2.2 CONTINUED to September 22, 1992 Report from County Administrator regarding proposed lease with AB Lease for undeveloped land located at Buchanan Field Airport to provide opportunity for review by the Aviation Advisory Committee. (V absent) 2. 3 DETERMINED to extend to January 31, 1993 the terms of Supervisors Tom Torlakson and Tom Powers, together with their alternates, Supervisors Nancy Fanden and Robert Schroder, as the Contra Costa County representatives to the Association of Bay Area Governments' executive board. 2. 4 INTRODUCED ORDINANCE extending regional planning commisions to October 1, 1993, FIXED September 22, 1992 for adoption, and REQUESTED Director of Community Development to review and report at the end of one year on the Board's request that the Zoning Administrator batch issues and meet in the Community when feasible.
