SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Adopt resolution designating Contra Costa County as the Lead Agency for the Preparation of an Environmental Impact Report for the Pacheco/Buchanan Field Redevelopment Plan. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS Section 15050 of the California Environmental Quality Act (CEQA) Guidelines requires that when a project requiring an Environmental Impact Report (EIR) is to be carried out or approved by more than one public agency, one public agency shall be responsible for preparing the EIR for the project. This agency shall be called the Lead Agency. On July 28, 1992, by Resolution No 92/505, the Contra Costa County Board of Supervisors designated a survey area in the Pacheco/Buchanan Field area for the proposes of study to determine the feasibility of the creation of a redevelopment project within said survey area. On September 22 , 1992, by Resolution No. 49-1992, the Contra Costa County Planning Commission selected a project area and adopted the Preliminary Plan for the Pacheco/Buchanan Field Redevelopment Project. k THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA 1992 Adopted this Order on October 6, by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson, McPeak NOES: None ABSENT: None 4BSTAIN: None RESOLUTION NO. 92/681 SUBJECT: DESIGNATION OF THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY AS THE LEAD AGENCY FOR THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT FOR THE PACHECO/BUCHANAN FIELD REDEVELOPMENT PROJECT AND AUTHORIZING TRANSMITTAL OF DRAFT REDEVELOPMENT PLAN AND DRAFT ENVIRONMENTAL IMPACT REPORT UPON COMPLETION WHEREAS, Section 15050 of the California Environmental Quality Act Guidelines (the "CEQA Guidelines") requires that when a project requiring an environmental impact report ("EIR") is to be carried out or approved by more than one public agency, one public agency shall be responsible for preparing the EIR for the project. This agency shall be called the Lead Agency; and WHEREAS, the Board of Supervisors of Contra Costa County (the "Board") and the Redevelopment Agency of Contra Costa County (the "Agency") are the public agencies involved in the preparation and adoption of the Redevelopment Plan for the Pacheco/Buchanan Field Redevelopment Project (the "Plan") for which an EIR shall be prepared, and both agencies have responsibilities related to approving and carrying out the Plan; and WHEREAS, pursuant to the standards set forth in Section 15051 of the CEQA Guidelines, the Board and the Agency each has a substantial claim to be Lead Agency; and WHEREAS, Section 15051 of the CEQA Guidelines provide that where two or more public agencies have a substantial claim to be the Lead Agency, the public agencies may by agreement designate one of the agencies as the Lead Agency; and WHEREAS, the Board and the Agency have mutually agreed that the Board, as the legal entity responsible for approving and adopting the Plan in the first instance pursuant to the California Community Redevelopment Law should serve as the "Lead Agency, " and the Agency should serve as a "Responsible Agency" as defined in the CEQA Guidelines; and WHEREAS, staff is in the process of initiating a Draft EIR and Draft Plan; and WHEREAS, upon completion of the Draft EIR and Draft Plan, and subsequent to initial consultation with the fiscal review committee, if one is created, California Community Redevelopment Law and the CEQA Guidelines require that a copy of the Draft EIR and Draft Plan be sent to each affected taxing entity, to the fiscal review committee (.if one is created) , and to various other interested persons and entities. NOW, THEREFORE, BE IT RESOLVED that the Board hereby consents to its designation as the Lead Agency for purposes of the preparation of the EIR for the Plan. RESOMION NO. 92/681 4. BE IT FURTHER RESOLVED that the Board acknowledges that the Agency, in considering adoption of the Plan pursuant to Health and Safety Code Section 33367, shall serve as a "Responsible Agency" within the meaning of Public Resources Code Section 21069. BE IT FURTHER RESOLVED that staff is further authorized to proceed with the preparation of the Draft Plan and Draft EIR; and to continue the procedures or consultation on and review of said documents as mandated by the California Community Redevelopment Law and all other applicable laws and regulations.
