SUBJECT: ORDINANCE AMENDMENT REGARDING DISCHARGE OF FIREARMS IN
UNINCORPORATED AREAS
Specific Request(s) or Recommendation(s) & Background & Justification
RECOMMENDATIONS:
Introduce ordinance amending Section 44-4. 004 of Chapter 44-4 of the County
Ordinance Code governing the discharge of a firearm in designated places.
Fix October 13, 1992 for adoption.
FINANCIAL IMPACT-
No financial impact is anticipated.
REASONS FOR RECOMMENDATION/BACKGROUND:
There is a history of complaints regarding the discharge of firearms in
certain unincorporated areas of the County. In researching the County
Ordinance Code, it was discovered that there is no, prohibition against this.
To remedy this situation, an ordinance is being proposed to amend Section
44-4. 004 of Chapter 44-4 of the County Ordinance Code.
The proposed amendment would prohibit discharging a firearm in any public
place, including adjacent to or in the direction of any public place, as well
as in any private place located in a district zoned residential or
commercial. Violation of the prohibition would constitute an infraction
punishable by maximum fines of $100 for the first violation, $200 for second
violation within a year, and $500 for each additional violation within one
year. The implementation of this ordinance will be mo red and more
restrictive remedies will be proposed if required.:
