SUBJECT: Authorize Share of AB 939 Fees to Participating Cities
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
ACCEPT attached resolutions from participating cities to implement allocation
of $ . 80/ton of the AB 939 Fees according to the relative yearly population of
each participating city with a proviso that all participating cities receive
at least $10,000 per year;
AUTHORIZE the Community Development Department and Auditor-Controller to
disburse the funds to each participating city, on a quarterly basis, using
the 1990 population data for the disbursements through June, 1992 and,
thereafter, using the population data prepared by the State Department of
Finance; and,
DIRECT the Community Development Department to assess the AB 939 Fee
allocation program in 1995 .
FISCAL IMPACT:
None to the County General Fund. Annual revenues to the County from its
share of the AB 939 Fees ( $ . 15/ton) are estimated to be $120,000. These are
dedicated funds usable only for solid waste planning and implementation.
Third Quarter 1991 disbursements to the cities will equal $101, 620. 80.
Assuming constant tonnage receipts for a year, yearly revenues to the cities
would be: Antioch, $51,402. 24; Concord, $95, 983 . 00; Danville, $25, 894. 36;
Lafayette, $19,324. 16; Martinez, $26,280 . 84; Moraga, $13,140. 40; Orinda,
$13 ,913 . 36; Pittsburg, $39,212. 80; Pleasant Hill, $26,280.84; San Ramon,
$28,986. 24; Walnut Creek, $49,856. 48; Brentwood, $10,000. 00; Clayton,
$10,000. 00

BACKGROUND:
On May 7, 1991 the Board directed staff to work with the cities and the Public
Managers to establish standards for collecting revenue on behalf of the cities in
lieu of reducing the $ . 95/ton AB 939 fee. This resulted in development of a
formula and resolution for cities to adopt if they wished to receive a portion of
the AB 939 Fee.
Under the formula adopted by all participating cities, the revenue resulting from
the $ . 80/ton fee is to be disbursed to participating cities on the basis of
population. The formula allocates the revenue on the basis of yearly population
of each city relative to the total population of all participating cities but
assures that each participating city will receive at least $10, 000 annually.
The five cities in West County (Richmond, El Cerrito, San Pablo, Hercules, and
Pinole) chose not to participate in the revenue sharing process/formula. Between
July and December, 1991 resolutions were received from all other cities in the
county requesting collection of the fees and allocation of the revenues on the
basis of population. (Resolutions attached)
For 1991, the Census population data will be used to expedite the disbursement
process. Beginning in July, 1992, population data will be based upon the State
Department of Finance' s population data.
To comply with the proviso that all participating cities shall receive at least
$10,000 annually (applicable to Brentwood and Clayton) , the formula used to
calculate each city' s share of the AB 939 that does not receive the minimum will
be:
tonnage x $. 80/ton - minimum payments x city population
percentage (excluding minimum city populations) .

CITY OF ANTIOCH REGARDING AB 939, RECYCLING FUND
WHEREAS, AB 939 allows for the collection of
revenue to finance AB 939 planning and implementation;
WHEREAS, the Board of Supervisors has advised the
City that its revised AB 939 budget and revenue projections
will allow for collecting an $.80/ton AB 939 surcharge at the
landfills on behalf of the cities without any increase in the
surcharge;
WHEREAS, expenditure of the surcharge revenue would
be within the sole discretion of the city, and the city
recognizes that the County has no responsibility to verify the
appropriateness of. such expenditures;
WHEREAS, the city intends that revenues will be
used for AB 939 purposes;
NOW, THEREFORE, BE IT RESOLVED that the City of
Antioch hereby requests Contra Costa County to continue to
collect the $.80/ton surcharge at the landfills/transfer
stations and disburse it to the City and other participating
cities in accordance with the following:

2. City recognizes that the County will send
payments quarterly following receipt of payment to the County
from the landfill/transfer station operator and that the first
payment will be for the period of July - September, 1991.
3. Unless terminated earlier by the City, the

January 1, 1995, at which time participating cities and the
County will assess its continuance.

RESOLUTION NO. G3 -91.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANT HILL
" REGARDING AB 939 (RECYCLING) FUNDING
WHEREAS, AB 939 provides for the collection of revenue to
finance local waste management efforts; and
WHEREAS, the county has been collecting such revenue for
unincorporated areas this past year; and
WHEREAS, the County recently determiriod that- it needs only
$ . 15 per ton of the $ . 9.� per ton waste fee it has been collecting
on behalf of unincorporated areas at the landfill and transfer
station so has offered the $ . 80 per ton balance to county cities;
and
WHEREAS, the county wants to know whether cities wish to
receive this $ .80 per ton balance, and if so, how it, should be
divided up between the various cities;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Pleasant Hill that the City of Pleasant Hill hereby petitions
Contra Costa County to continue to collect the $ . 80/ton surcharge
at the landfills/transfer stations and disburse it to the City and
other participating cities according to a formula based on
population or tonnage, as may be agreed upon between the majority
of the cities and the County. The City of Pleasant Hill prefers
that said disbursement be in accordance with the following :

RESOLUTION REQUESTING THE COLLECTION AND DISBURSEMENT OF
TIPPING FEES FOR AB 939 PURPOSES
The City Council of The City of San Ramon resolves:
WHEREAS,AB 939 allows for the collection of revenue to finance required planning
and implementation activities;
WHEREAS, the Contra Costa County Board of Supervisors has advised the City that
its budget projections will allow for collecting an $0.80 per ton AB 939 surcharge at the
landfills on behalf of the Cities of Contra Costa County without any increase in the
surcharge;
WHEREAS, the expenditure of the surcharge revenue will be within the sole
discretion of the City, and the City recognizes that the County has no responsibility to verify
the appropriateness of such expenditures;
WHEREAS, the City intends the revenues to be used for AB 939 planning and
implementation purposes;
WHEREAS, the City passed resolution No. 91-114 on July 15, 1991, requesting that
the County collect the $0.80 per ton tipping fee and distribute it to the cities based on yearly
city tonnage;
WHEREAS, the majority of the participating cities requested distribution of the
tipping fee on the basis of population;
WHEREAS, the City recognizes that all participating cities must agree on the
distribution method;
NOW,THEREFORE,BE IT RESOLVED, that the City of San Ramon hereby repeals
Resolution No. 91-114 and requests that Contra Costa County continue to collect the $0.80
per ton surcharge at the landfills/transfer stations and effective July 1, 1991 disburse it to
the City of San Ramon and other participating Cities in accordance with the following:
