SUBJECT: REPORT ON DELTA ADVISORY PLANNING COUNCIL POTENTIAL EXPANDED FUNCTION
AS A REGIONAL AGENCY
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Encourage the Delta Advisory Planning Council to explore the
feasibility of a Delta Compact (expanded joint powers agreement, or
Memorandum of Understanding) for Land Use Planning authority in the
Delta area, and produce a concept paper for member County review.

None at this time.
BACKGROUND/REASONS FOR RECOMMENDATIONS
In May of 1991, the State Lands Commission released a report
detailing degradation of Delta resources in many areas. This in
turn, caused concern at the State level, resulting in the formation
of a Senate subcommittee on Delta Protection, Chaired by Senator
Pat Johnston. Both the State Lands Commission and the Subcommittee
are looking toward methods of Delta management, including formation
of a Delta. Regional agency. There is some evidence that other
groups may be advocating an Environmental Management Agency as
well.
Board policy, passed October 1, 1991, recommended enforcement of
existing law and indicated a need for new state law to protect
reasonable beneficial uses. This policy also stated that a decision
on the need for a regional agency at that time was premature. In
addition, this policy recommended that if a new organization is
proposed, no new layers of bureaucracy should be established, and
priority should be given to coordination of established agencies.

The Delta Advisory Planning Council (DAPC) , put in place 18
years ago by the Delta Counties to address the regional agency
issue, is evaluating potential for and member support of a
DAPC as expanded regional agency scenario. Should DAPC assume
some level of responsibility on a regional basis, control of
these activities would remain at the local level. The Water
Committee recommends that regional agency authority focus on
land use issues such as wetlands preservation, law
enforcement, recreation, and growth management issues, as it
is not anticipated that any regional agency scenario would be
allowed to address controversial and complex water issues to
any significant degree. The Community Development Department
is preparing additional policy and recommendations, including
a map of proposed revised Delta boundaries which could aid in
formation of scope of a proposed regional agency or plan.
