OPPOSING THE QUALIFICATION OF LOCAL MEASURES FOR THE BALLOT

RECOMMENDATIONS:
1 . Introduce the attached Ordinance which further regulates
committees formed or existing primarily to support or oppose
the qualificiation of, or passage of, a local ballot measure
which is being voted on only in this jurisdiction, waive
reading andl fix January 14, 1992 for adoption of the
Ordinance.
2 . Direct the 'County Administrator to file a copy of the
attached Ordinance, once adopted by the Board of
Supervisors,'lwith the Fair Political Practices Commission as
is required ,
!by Government Code Section 81009 .5(a) .

BACKGROUND:
As a part of th'e Board' s 1991 Legislative Program, the Board
agreed to sponsor legislation which would allow the Board to
further regulate committees which are formed primarily to support
or oppose the qualification of local measures for the ballot.
The Board already;; has the authority to regulate local candidates
and their committees, committees which are formed to support or
oppose a candidate, as well as county general purpose committees
which are activel'only in this County. However, the Board had no
authority to regulate committees which are formed primarily to
support or oppose the qualification of a local measure for the
ballot.

The Board, therefore sponsored legislation in 1991 which would
provide authority for local agencies to regulate committees which
are organized primarily to support or oppose the qualification of
a local measure for, the ballot. This language was eventually
placed in Senator Marks ' SB 595 as an amendment to Government
Code Section 81009 .5 which was enacted and is now Chapter 674,
Statutes of 1991 . This law becomes effective January 1, 1992 .
The attached Ordinance has been prepared by County Counsel for
the purpose of implementing these provisions of SB 595 in Contra
Costa County.
