The Board of Supervisors of Contra Costa County Resolves That:
It appears from evidence presented by The Contra Costa County
Building Inspector the above subject property has some substandard
buildings. Some of the structures are repairable, some are
uninhabitable and subject to abatement by demolition. Such
structures constitute a hazard to and endanger the health, safety
and welfare of the public. There also exists a considerable amount
of garbage and debris.
The hearing is continued for 60 days to allow time for reconveyance
of the property which is now in foreclosure, which makes it
difficult to assign ownership responsibility. The Board requests
a report on November 17, 1992, on a plan for the structures on the
property.
Furthermore, there are some conditions on the property which
require immediate attention. Jurisdiction to abate the garbage and
debris and to secure any hazardous conditions in the partially
dismantled structures is hereby granted to the County Building
Inspector. A lien shall be placed against the subject property for
the cost of the abatement. A report is requested in 30 days on the
health and safety issues, including removal of garbage.
The Building Inspection Department is directed to post and mail
notices of this resolution directing abatement of the nuisance in
the manner required by law and for the period required prior to any
actual abatement.

SUBJECT: Proposed Abatement of real property at 112 Alves Lane,
Pittsburg, Frederick H. Forschler, owner
The Board this date held its scheduled hearing on the proposed
abatement of real property at 112 Alves Lane, Pittsburg, Frederick H.
Forschler, owner.
Roy Milgate of the Building Inspection Department described the
property and advised that the Department felt that some of the
buildings should be demolished and some could be rehabilitated.
The following persons appeared to speak on the issue:
1. Larry Bellinger, 1850 Gateway Boulevard, #1050 , Concord,
representing the receivers of the property and holder of the second
mortgage, noted that a bankruptcy had been filed, and as soon as title
is cleared and they have authority to go onto the property, they will
start cleaning it up. He requested that the Board allow them to come
back to the Board with a plan.
2. Joseph Canciamilla, 2211 Railroad Avenue, Pittsburg, appeared
on behalf of Lerman Mortgage who had issued a loan on the property.
He agreed with the description of the problems, and noted that his
clients cannot go onto the site because they are not the the legal
owners. He requested that the Board give his client the opportunity
to get the title issue resolved and gain access to the property and
then work with the Building Inspection Department to determine what
can be saved.
3 . Helen Turney, 66 Avon Way, Martinez, representing the Avon
Refinery Federal Credit Union, noted that payments on the property had
not been made and therefor the Credit Union had to go into
foreclosure. She urged that the property be cleaned up.
John Scharetg, 398 Nut Tree Road, Vacaville, had submitted a
speaker card, but declined to speak.
Supervisor Torlakson expressed concern with the accumulation of
garbage and health issues and inquired if the County could do
something. Mr. Milgate responded that if the County were to do
anything about the garbage, it would have to be through the Health
Department, but that garbage accumulates very fast there and it would
have to be a continuing effort. .
The Board discussed the matter in some detail and adopted the
attached Resolution No. 92/604.
