HomeMy WebLinkAboutMINUTES - 09081992 - H.12 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on September 8, 1992 by the following vote : AYES : Supervisors Fanden, Schroder and McPeak NOES : None ABSENT: Supervisors Powers and Torlakson ABSTAIN: None ---------------------------------------------------------------- ---------------------------------------------------------------- SUBJECT: Hearing on Rezoning Application 2884-RZ, Final Development Plan 3004-90 and Subdivision 7462 In The Diablo/Blackhawk Area (Black Oak Estates) . Now is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the San Ramon Valley Regional Planning Commission on the request by Bryan and Murphy Associates (applicant) and Black Oak Estates (owner) to rezone 47 acres of land from General Agricultural (A-2) to Planned Unit District (P-1) (2884-RZ) , for final development plan approval for a 45-unit single family residential and open space project (DP 3004-90) , and for vesting tentative map approval to subdivide 47 acres into 45 lots and open space area (Subdivision 7462) in the Diablo/Blackhawk area. Robert Drake, Community Development Department, presented the staff report on the proposed project, described the site location, and commented on the staff recommendation that the Board take testimony, close the hearing and declare its intent to approve the project in accord with the Planning Commission' s recommendation, and direct staff to come back for adoption of findings and final approval action. Mitch Avalon, Public Works Department, spoke on the drainage issue in the area, and the various proposed drainage improvement projects by the development . The public hearing was opened and the following persons presented testimony: Mike Bedeker, 2145 Hidden Oak Drive, Danville, a co-owner of the property, spoke in favor of the proposed project . Richard Swanson, 2224 Alameda Diablo, Diablo, representing the Diablo Community Service District, requested that the project be turned down in its present state, and he presented a letter dated September 2 , 1992, from the Law Office of Jenkins, Goodman and Newman who represent the Diablo Country Club requesting a postponement of the hearing for at least 30 days . William Wood, Crain and Wood Architects, 301 Hartz Avenue, Suite 203 , Danville, presented written material and spoke in opposition to the present proposed project . The following persons appeared in opposition and expressed concerns on various issues including drainage, conditions of approval, the Environmental Impact Report, the trails and staging area, fire safety, the scenic corridor, water supply, sensitive plant species, grading, and schools : Robert Scharnell, 2154 Alameda Diablo Road, Diablo; Charles A. Box 44 , Martinez, representing Save Mt . Diablo; Byron J. Sasham, 2358 Alameda Diablo, Diablo; Nancy Seibert, 2421 Mt . Diablo Scenic Boulevard, Diablo; Gun L. Johnston, 2355 Mt . Box 259, Diablo, representing Diablo Property Owners ' Association; Gayle Bishop, 2800 Finley Road, Pleasanton; Dorothy Petersen, 120 El Centro, Diablo; Bob Doyle, Peralta Oaks Court, Oakland, representing East Bay Regional Park District; Gerald Salvesen, 30 Cameron Court, Danville; Joe Willingham, 2512 Etan Street, Berkeley, representing the East Bay Chapter of the California Native Plant Society; Sho-Li Cheng, 2439 Mt . Diablo Scenic Boulevard, Diablo; David Preiss, 2375 Holly Oaks Drive, Danville, representing Hidden Oaks at Blackhawk Association; The following persons presented testimony in support of the project : Roderic B. Park, 531 Cliffside Court, Pt . Richmond, Chair of the Athenian School Board of Trustees . David Lonnage, co-owner of the property, spoke in rebuttal . The public hearing was closed. Supervisor Schroder commented on calls and postcards he had received concerning this proposal, and he spoke on the rights of the property owner. Mr. Schroder commented on various concerns that had been raised today, advised that he was not prepared to make a recommendation, and he moved to defer decision to October 6, 1992, at 10 :45 a.m. in the Board chambers . Supervisor McPeak clarified issues to be addressed including the location of lots, the magnitude of cut and fill, drainage, and the trail location. IT IS BY THE BOARD ORDERED that the decision on the above matter is DEFERRED to October 6, 1992 , at 10 :45 a.m. in the Board' s Chambers; and Public Works Department staff and Community Development Department staff are DIRECTED to respond to concerns raised today.
