MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: SEPTEMBER 8, 1992 SUBJECT: EXERCISE OF OPTION TO PURCHASE MORAGA LIBRARY - MORAGA AREA Project No.: 3860-6X5208 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: A. AUTHORIZE the Public Works Director to notify the Board of Retirement of Contra Costa County Employees Retirement Association that the County is exercising its option to purchase the Moraga Library located at 1500 St. Mary's Road, Moraga, as provided in the Lease/Option Agreement dated June 12, 1973, between the County and the Board of Retirement of Contra Costa County Employees Retirement Association. B. AUTHORIZE the Public Works Director to do what is necessary to complete the purchase from the Board of Retirement of Contra Costa County Employees Retirement Association. C. ACCEPT the Quitclaim Deed from the Board of Retirement of Contra Costa County Employees Retirement Association. D. APPROVE payment of $9,363.00 as of October 13, 1992, for said property rights and AUTHORIZE the Auditor-Controller, Accounts Payable Division, to make a journal entry in the amount of $9,363.00 to affect payment agreed upon. E. DIRECT the Public Works Department, Real Property Division to have said Quitclaim Deed recorded in the office of the County Recorder. II. Financial Impact: Payment of the $9,363.00 shall be provided for in'the General Services Budget. Accounting Recorder (via R/P) Moraga Library Exercise to Option to Purchase September 8, 1992 Page Two III. Reasons for Recommendations and Background: On June 12, 1973, the County entered into a lease with option to purchase agreement with the Board of Retirement of Contra Costa County Employees Retirement Association resulting in the construction of the Moraga Library. As of October 13, 1992, one final payment of $9,363 is required to be paid to the Retirement Association. The Retirement Association has requested this payment upon receipt of which it will deed the library property to the County. IV. Consequences of Negative Action: The County has agreed to transfer this property to the Town of Moraga upon completion of the transfer from the Retirement Board to the County. To not complete this transfer would be contrary to the County's previous agreement with the Town of Moraga.
