Amend Board Order of June 4, 1991 related to approval of 1991/92 County Justice System Subvention Program and related contracts, as follows: a. Increase the District Attorney's PERFORMANCE OF AB 3121 FUNCTIONS project from $221,886 to $282,084 by allocating $60,198 of 1990/91 carryover Subvention Funds to that project. b. Increase the Criminal Justice Agency's PLANNING, COORDINATION, EVALUATION AND ADMINISTRATION project from $20,001 to $40,151 by allocating $20,150 of 1990/91 carryover Subvention Funds to that project and authorize the County Administrator, or his designee, to execute an amended contract on behalf of the County with the Criminal Justice Agency. 2. Approve required appropriation and revenue adjustments (APOO 5088 & RA00 5088) and AP00 5087 & RA00 5087) . FINANCIAL IMPACT: Fiscal year 1990/91 Subvention Funds (commonly referred to as AB 90) are available for expenditure through June 30, 1992. These funds must be utilized by June 30, 1992 or they revert to the State. Use of these funds will enable successful completion of activities within both the District Attorney's Office and the Criminal Justice Agency that were approved in the FY 1991/92 budget. REASONS FOR RECOHMENDATION/BACKGROUND: On June 4, 1991, your Board took . various actions related to approval of project amounts and contracts for the 1991/92 County Justice System Subvention Program (formerly AB 90) . DEPUTY Amendment to 1991/92 County Justice System Subvention Program: Allocation of 1990/91 Carryover Funds Page 2 December 4, 1991 Approval of the above recommendations will. have the following programmatic and fiscal consequences: 1. This project permits the District Attorney to prosecute Juvenile Delinquency cases pursuant to Welfare and Institutions Code 602. This prosecution is mandated by State law and Subvention funds are the only funds available to the County to cover the cost of this mandate. The additional carryover funds for this fiscal year will enable the District Attorney to maintain timely prosecution efforts on such cases without creating unacceptable delays and backlog. the Final FY 1991/92 Budget includes these funds. 2. The Criminal Justice Agency has continued. to do much of the required planning and management of Propositions 2, 16, 52, and 86 within the County which provide funds for the construction of County correctional facilities. Construction of the West County Justice Center, the various upgrades at both Marsh Creek and Martinez Detention Facilities have been completed. However, some project closeout tasks have yet to be done which are aimed at maximizing the reimbursement by the State of various costs associated with construction. In addition, work is underway to prepare an application for additional State bond funds for construction of housing to deal. with inmates with substance abuse problems. CONSEQUENCES OF NEGATIVE ACTION. These State funds must be utilized by June 30, 1992.
