Mental Health Consumer Concerns, Inc.
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION

I. RECOMMENDED ACTION:
Approve and authorize the Chair to execute on behalf of the County,
Contract Amendment Agreement #24-238719, effective January '1,1, 1992, to.
amend Novation Contract #24-238-18 with Mental Health Consumer
Concerns, Inc. , (effective July 1, 1991 through June 36—, -1693) to add
Reise Review Hearing services and to increase the Contract Payment
Limit by $52 ,930, from $259, 904 to a ' new total Contract Payment Limit
,of $312 , 834 , to cover the cost of the --add•itional services. This
Contract includes a six-month automatic extension for the 'period from
July 1, 1993 through December 31, 1993 , and this Contract Amendment
Agreement provides for a $15, 346 increase in the extension period
payment limit from $64 , 976 to a new six-month payment limit of $80, 322 .

II. FINANCIAL IMPACT:
This contract is included in the Health Services Department, budget for
Fiscal Year 1991-92 and will be included in the Department' s Fiscal
Year .1992-93 budget.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
On December 3 , 1991, your Board approved Novation Contract+ #24-238-18
with Mental Health Consumer Concerns,; Inc. for provision of a Patients '
Rights Advocacy Program which includes general advocacy and training
services; Certification Review (Doe vs. Gallinot) Hearing representa-
tion (under AB 3454) ; and administration of self-help activities. . , . ..
On October 7, 1991, the California ! State Legislature passed SB 665
mandating informed consent, emergency medication and capacity hearing
procedures to implement Riese vs. St. Mary' s Hospital and Medical
Center, the 1989 judicial decision which recognized the right of mental
health patients to give, or refuse, consent to medication.' The law,
which became effective January 1, 1992 , mandates that: . (1). Capacity,
hearings are to be held within 72 hours of filing the petition at the

facility/hospital in which the patient is receiving treatment; (2)
Hearings are to be conducted by hearing officers appointed by the
Superior Court from a list of attorneys unanimously approved by a panel
which includes the Mental Health Director; and (3) Patients are
entitled to assistance from a patients ' rights advocate.
Approval of Contract Amendment Agreement #24-238-19 will allow the
Contractor to provide the State-mandated Riese "capacity" review
hearings in addition to the patients ' rights services it already
provides under the terms of Novation Contract #24-238-18 . jj
