ORDINANCE AMENDING THE FEE AND SERVICE CHARGE REVENUE/COST
SUBJECT: COMPARISON SYSTEM (ORDINANCE CODE CHAPTER 70-2) TO INCLUDE
SERVICES OF ASSESSOR, AUDITOR-CONTROLLER, CLERK OF THE
BOARD, COUNTY CLERK, AND THE TREASURER-TAX COLLECTOR
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt ordinance amendment setting percentage of cost to be
recovered through fees for services provided by the Assessor,
Auditor-Controller, Clerk of the Board, County Clerk and the
Treasurer-Tax Collector, as recommended by County Administrator
and Auditor-Controller' s Office.
FISCAL IMPACT:
Adoption of this ordinance will probably result in higher user
fees more in line with the actual cost of service provision. As
a consequence, reliance on property administration taxes (SB2557)
and General Fund revenues should decrease for tax functions,
Recorder, Elections, and the Clerk of the Board.
BACKGROUND:
Ordinance was introduced and reading waived on February 11, 1992 .
It is to be considered in conjunction with a resolution to
increase and/or establish fees for the Assessor, Auditor-
Controller, Treasurer-Tax Collector, County Clerk, and the Clerk
of the Board. The Public Hearing for the resolution is also on
today' s agenda.

Management Services Institute (MSI ) has completed their second
report for a three year, Countywide, fee study.. This report
reviews services provided by the Assessor, Auditor-Controller,
Treasurer-Tax Collector, Clerk of the Board, and the Recorder and
Election functions of the County Clerk. Last fall MSI submitted
their first report on Land Development services . Each report
identifies services offset by fee revenues .
The attached ordinance lists .the services from both reports and
recommends the percentage of service costs to be recovered with
fee revenue. Adoption of this ordinance sets policy guidelines
for tax section, Recorder, Elections, and related service fees
based on revenue/cost comparisons . The ordinance only includes
those services for which the County has authority to establish
and set fee levels . Unfortunately the County' s fee setting
authority only applies to one-half of the services in report two.
This ordinance will be revised when MSI completes another set of
departmental services that can be offset by fees . It is in fact
a revision of an earlier ordinance adopted in August 1991 that
only listed land development services . Ultimately, one ordinance
listing all fee related services will exist; thus giving the
Board the ability to perform a comprehensive review of all
services . Ideally all public hearings and policy related to fees
would be done by the Board at one time, with resolutions
implementing specific fees to be scattered throughout the year.
One comprehensive fee policy ordinance will also be useful to the
County Administrator' s budget staff.

(Adding Tax, Recorder, Elections, Clerk of the Board and
Miscellaneous Services to Fee and Service Charge Revenue/Cost
Comparison System)
The Board of Supervisors of Contra Costa County ordains as follows
(omitting the parenthetical footnotes from the official text of the
enacted or amended provisions of the County Ordinance Code) :
SECTION I . SUMMARY. This ordinance amends County Ordinance Code
Section No. 70-2 . 008, to add certain tax, county recorder,
elections, clerk of the board and miscellaneous fees to the list of
fees and service charges therein, and revises percentages for
certain land development fees .
SECTION II . Section 70-2 . 008 of the County Ordinance Code is
amended, . 1 ) to add certain fees for tax, county recorder,
elections, clerk of the board and miscellaneous services to the
list of fees and service charges, 2) to modify the numbering
system used for the fees and service charges, 3) to eliminate the
solid waste exporting and franchise fee, and 4 ) to change the cost
recovery percentages for the following fees: L.U.P. (second
residence/unit) ; L.U.P. (home occupation) ; L.U.P. (development plan
combination) ; zone variance (administrative) ; planning commission
appeal review; appeals to the board; reconsideration review; and
agricultural preserve zoning review, to read:
70-2 . 008 Schedule of Fees and Service Charcres . (a) The
county administrator, auditor-controller and each county department
head, under the direction of the county administrator, shall review
annually the fees and' service charges listed herein, and provide an
adjusted fee or charge schedule to the board for its consideration
and approval so as to recover the listed percentage of costs
reasonably borne necessary to provide the listed regulation,
product .or service. Unless :the board determines otherwise at the
time it fixes specific fees and charges pursuant to Section 70-
2 . 010, the percentages set forth herein should be utilized.

(b) A minimum fee of $10 . 00 shall be charged in all
instances except where noted.
(c) All fees and charges set pursuant to this chapter and
section shall take effect ten ( 10 ) days after the county
administrator signs an executive order stipulating that all
provisions of this chapter have been met.
(d) The schedule of frequency of rate adjustments may be
varied by the county administrator to adjust revenues sufficient to
meet debt service coverage requirements of any bond, certificate,
or ordinance, resolution, indenture, contract, or action under
which securities have been issued by the county which contain any
coverage factor requirement.
(e) The county administrator may vary the review schedule
listed in this section if, in the judgement of the county
administrator and a directly affected and requesting department
head, a gross inequity would be perpetrated by not considering the
revision of the percentage rate schedule. Any such proposed rate
revision which deviates from the review schedule as set herein
shall be reported to the board at its next succeeding meeting or at
the time consideration is being undertaken pursuant to Section 70-
2 . 010 to modify established fees and charges .

SECTION III . EFFECTIVE DATE. This ordinance becomes effective 30
days after passage, and within 15 days after passage shall be
published once with the name of the Supervisors voting for and
against it in the Martinez News Gazette, a newspaper published in
this County.
