No.: 8480 Task: ACQ Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE Right of Way Contract and ACCEPT Grants of Easement dated February 5, 1992, from Carmen M. Viano and Clement A. Viano, and Clement A. Viano. B. AUTHORIZE Chief Engineer to execute said Right of Way Contract on behalf of District. C. APPROVE payment for said property rights and AUTHORIZE the Auditor-Controller to issue a check in the amount of $2,500 payable to Carmen M. Viano and Clement A. Viano, 150 Morello Avenue, Martinez, CA 94553, to be forwarded to the Real Property Division for delivery. D. DIRECT the Real Property Division to have above-referenced Grants of Easement recorded in the office of the County Recorder. II. Financial Impact: Payment totalling $2,500 from Drainage Area 57 funds. Reasons for Recommendations: The Flood Control District is planning to construct a drainage retention basin and outfall facilities on adjacent property. Property rights being conveyed by the Viano family will provide an access road for construction and maintenance of the basin. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with approved plans and specifications. z
