Reorganization

This resolution is adopted pursuant to the Cortese-Knox Act
(Gov. Code, S§ 56000-57550 ) .
This proposal is for concurrent annexation of the subject
uninhabited territory to County Service Area R-7A (CSA R7A) and
the East Bay Municipal Utility District (EBMUD) . The reason for
the proposed change of organization is to allow efficient
provision of water and recreational services to the subject
territory. The exterior boundaries of the subject territory are
as described in Exhibit A hereto. The spheres of influence of the
aforenoted agencies have been amended by the Local Agency
Formation Commission to be consistent with the proposed
annexations .
The terms and conditions for the change of organization, as
specified by the Local Agency Formation Commission, are that:
l .The affected territory will be taxed for any existing
bonded indebtdness of CSA R7A and EBMUD. The regular county
assessment roll will be used for the collection of taxes and
assessments in the subject territory.
2. The affected territory shall .be subject to all applicable
ordinances, rules, regulations, and contractual obligations
of the annexing agencies .
Acting as a responsible agency under CEQA, this Board hereby
certifies that it has reviewed and considered the EIR prepared by
the County as lead agency for the project. Further, this Board,
acting as a responsible agency, hereby adopts the findings,
explanations, and statement of overriding concerns of the County,
acting as lead agency.
A noticed public hearing was held on this proposal on
January 14 , 1992 . No one appeared in opposition to the proposal .
This Board has determined that no protests have been filed
against the proposal .
This Board hereby approves and orders the proposal, subject
to the aforestated terms and conditions .
The Clerk of this Board shall forthwith transmit a certified
copy of this Resolution, along with a remittance to cover any
. applicable fees as provided by Government Code Section 57200, to
the Executive Officer of the Local Agency Formation Commission.
