HomeMy WebLinkAboutMINUTES - 02141992 - 1.8 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on January 14, 1992 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson and McPeak NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.92/23 SUBJECT: Approval of the Parcel Map and Subdivision Agreement and Completion of Improvements for Subdivision MS 123-90, Walnut Creek Area. The following documents were presented for Board approval this date: The Parcel Map of Subdivision MS 123-90, property located in the Walnut Creek area, said map having been certified by the proper officials. A Subdivision Agreement for Improvement Warranty with V & V Properties, Incorporated, subdivider, whereby said subdivider agrees to warrant all improvements as required in said Subdivision Agreement for Improvement Warranty within one year from the date of said agreement. Said documents were accompanied by: I. Security to guarantee the warranty of drainage improvements as required by Title 9 of the County Ordinance Code,.as follows: A. Cash deposit (Auditor's Deposit Permit No. 200454, dated December 24, 1991) in the amount of $1,000 made by V & V Properties, Incorporated. B. Additional security in the form of a cash deposit (Auditor's Deposit Permit No.200454, dated December 24, 1991)in the amount of$11,090 ($1,790 for faithful performance and $9,300 for labor and materials) made by V & V Properties, Incorporated. II. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map.and that the 1991/92 tax lien has been paid in full; The Public Works Director having notified this Board that the improvements for Subdivision MS 123-90, being developed by V & V Properties, Incorporated, have been completed and that such improvements have been constructed without the need for a Subdivision Agreement; NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of December 23, 1991, thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement for Improvement Warranty; BE IT FURTHER RESOLVED that the$9,300 cash security for labor and materials (Auditor's Deposit Permit No. 200454, dated December 24, 1991) deposited by V & V Properties, Incorporated be RETAINED for the six-month lien guarantee period until June 23, 1992, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file; BE IT FURTHER RESOLVED that said subdivision, together with the provisions for its design and improvement,is DETERMINED to be consistent with the County's general and specific plans. Approve Parcel Map & Subdivision Agreement MS 123-90 January 14, 1992 Page Two BE IT FURTHER RESOLVED that said Parcel Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement for Improvement Warranty is also APPROVED. BE IT FURTHER RESOLVED that the beginning of the one year warranty period is hereby established as of December 23, 1991, and the $2,790 cash deposit (Auditor's Deposit Permit No. 200454 dated December 24, 1991) made by V & V Properties, Incorporated be RETAINED for one year pursuant to the requirements of Section 94-4.406 of the Ordinance Code.
