SUBJECT: LEGISLATION: AB 2161 (Kelley)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of SUPPORT for AB 2161 by Assemblyman David
Kelley, which would amend existing law to allow any County in
California to become a part of an existing pilot project designed
to determine whether there are increased efficiencies from
establishing a negotiated net amount contract for alcohol and
drug programs .
BACKGROUND:
Under existing law (Section 11758 . 10 et seq. , Health & Safety
Code) seven named counties are a part of a pilot project which
allows those counties to negotiate contracts with the State
Department of Alcohol and Drug Programs for the difference
between the cost of services and the amount of projected revenue
(net negotiated amount) which would then represent the State's
obligation to fund programs in that County. Participation in
this pilot project waives most other planning and reporting
requirements for alcohol and/or drug programs . Under current law
(SB 156, Chapter 113, Statutes of 1991) the pilot projects expire
January 1, 1995 .
AB 2161 removes the reference to the named counties and allows
any county in California to participate in the pilot project.
The Health Services Director included support of this bill in his
requested 1992 Legislation Program. AB 2161 is sponsored by
CSAC. It appears that participation in this pilot project could
provide substantial opportunities to reduce the administrative
cost of providing alcohol and drug services in the County and
that it is, therefore, appropriate for the Board of Supervisors
to indicate their support for the bill .
