HomeMy WebLinkAboutMINUTES - 02111992 - H.3 H. 3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on February 11, 1992 by the following vote: AYES: Supervisors Powers, Schroder, Torlakson and McPeak NOES: None ABSENT: Supervisor Fanden ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Rezoning Application 2959-RZ, Development Plan 3020-91 and Subdivision 7655 , Bellecci and Associates/ North State Development Company, Oakley Area. This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request of Bellecci and Associates (applicant) and North State Development Company (owner) ( 2959-RZ) for approval to rezone 6 . 4 acres of land from Planned Unit District (P-1) for 26 units to Planned Unit District (P-1) for 37 units and for approval of a final development plan for 37 lots ( 3020-91) , and for approval to subdivide approximately 6. 4 acres of land into 37 lots (Subdivision 7655) .in the Oakley area. SUperv.isor McPeak advised of a request by the applicant for a continuance of two weeks, and of the Board' s intent to hear the staff report, take testimony today and continue the matter. Mary Fleming, Community Development Department, presented the staff report describing the site, the request for approval of 37 units, the Planning Commission approval for 34 units, and she requested a change in the conditions of approval on page 4, #10H related to a trail connection elimination which she advised would be prepared for Board consideration. Supervisor Torlakson informed the Board that he had visited the site with the Public Works Director and 'Mitch Avalon, Public Works Department, and Val Alexeef, Growth Management and Economic Development Agency, to look at traffic and circulation issues, and he commented on issues to be worked out including access in and out of the subdivision. Mitch Avalon, Public Works Department, commented on issues including temporary access, developments in the area and circulation Mary Fleming advised that the applicant was not present today, and was not able to make his presentation. The public hearing was opened and the following persons appeared to speak: David B. Wigglesworth, 2100 Chicory Drive, Oakley, spoke on concerns including density and consistency with the neighborhood. Supervisor Torlakson requested that the staff look into the issue of buffering and blending considerations. Benjamin Quen, 2160 Chicory Drive, Oakley, spoke in opposition on issues including comparable housing, circulation, and park access. Larken Vandermel, 2150 Chicory, Oakley, spoke in opposition on issues including comparable housing, changes in the General Plan, blending, and protecting the. value of their homes and requested that the developer be made to stay with 3-5 homes per acre. Supervisor Torlakson requested that staff compare the chronologies of densities for the 1987 and the 1990 Oakley General Plans. Loren E. Lemons, 4159 Blossom Court, Oakley, addressed concerns including blending, density and the operation of the planning process. Dave Rebello, 207 Dennis Court, Oakley, spoke in opposition and he requested clarification on the number of units being considered. Teresa. Bailey, 4120 Richard Way, Oakley, addressed concerns including access, safety of children and pets, and density. Supervisor McPeak clarified that Supervisor Torlakson had requested a, chronology of the changes in General Plan designations and any zoning on this parcel and the relationship today between the current General Plan and what is being proposed here. Supervisor McPeak requested staff to address what a citizen would have been told in 1990 had they called the County to ask what the plans were. Supervisor Torlakson requested clarification on the Oakley Municipal_ Advisory Council (GMAC) recommendation for this proposal. Supervisor Torlakson requested an estimate from Mitch Avalon on the cost and the possibility of continuing a proposed street to the west for another point of circulation. Mitch Avalon advised he would look into the cost. Supervisor Torlakson also requested staff to clarify the issue of the park access and he moved to continue this hearing for two weeks to February 25, 1992 at 2: 00 p.m. in the Board chambers.
