HomeMy WebLinkAboutMINUTES - 02111992 - 2.3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on February 11, 1992, by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson, McPeak NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 92/ 86 ------------------------------------------------------------------- ------------------------------------------------------------------- SUBJECT: Criminal Justice Administrative Fee Regulations WHEREAS, the Contra Costa County Board of Supervisors adopted County Ordinance 91-3 on January 22, 1991 implementing in Contra Costa County the provisions of Government Code section 29550 ( 1990 Statutes, Chapter 466, Section 1 (SB 2557) ) , which provide for criminal justice administrative (booking) fees; and WHEREAS, under County Ordinance 91-3, the Contra Costa County Board of Supervisors, by resolution, may adopt regulations governing the application and administration of the criminal justice administrative (booking) fee; WHEREAS, the Contra Costa County Board of Supervisors adopted Resolution 91/219 on April 16, 1991 governing the application and administration of the criminal justice administrative (booking) fee; NOW, THEREFORE, BE IT RESOLVED that the following regulations apply to the application and administration of the criminal justice administrative (booking) fee in Contra Costa County and that this resolution supersedes and replaces Board Resolution 91/219 : Section 1 . Definition of Chargeable Bookinqs . Chargeable bookings or processing shall include all bookings except those bookings resulting from court remands, court commitments, citizen's arrests, self-booking, arrests on foreign warrants, arrests on warrants issued to agencies other than the arresting agency and arrests resulting from the efforts of organized and approved task forces, strike forces or "nets" that involve multi-agency personnel which include the County of Contra Costa. "Foreign warrants" means those warants issued to agencies outside of the County of Contra Costa by courts outside of the County of Contra Costa. " Section 2 . Procedures for Invoicing. (a) Booking data for chargeable bookings for each agency shall be provided by the County Sheriff 's Department on a monthly basis to the Office of Revenue Collection. For each arresting agency, data shall include the name of the person booked, the date the person was booked, and the total number of chargeable bookings for the month. (b) The Office of Revenue Collection shall submit an invoice to every city, special district, school district, community college district, college or university, for the criminal justice administrative (booking) fees owed by such entity for the prior month and for fees not invoiced for previous months . Invoices shall be payable thirty (30) days from the date of invoice. Section 3 . Receipt of Payment. Paid fees shall be deposited by the Office of Revenue Collection in Budget Unit 0005, Account 9735. RESOLUTION NO. 92/86 n Section 4 . Billing Errors . Agencies discovering errors on invoices may contest a charge by submitting evidence validating the .error in writing to the County within thirty ( 30) calendar days of the invoice date. County DATE: c�rrq C5405U cT February 11, 1992 SUBJECT: CRIMINAL JUSTICE ADMINISTRATIVE (BOOKING) FEE REGULATIONS SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION Adopt resolution amending the criminal justice administrative (booking) fee regulations . This resolution supercedes and replaces Resolution 91/219 . FINANCIAL IMPACT It is anticipated that as a result of the amendment to the regulations, booking fee revenues will decrease by an unknown amount. REASONS FOR RECOMMENDATION / BACKGROUND On April 16, 1991, the Board of Supervisors adopted booking fee regulations in accordance with County Ordinance 91-3 . The regulations defined chargeable bookings to include bookings resulting from arrests on foreign warrants and arrests on warrants issued to agencies other than the arresting agency. Foreign warrants are those warrants issued to agencies outside of Contra Costa County by courts outside of Contra Costa County. It is recommended, however, that chargeable bookings be redefined to facilitate law enforcement.
