MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: February 11, 1992 SUBJECT: MIRANDA AVENUE BIKE PATH Project No.: 0662-6R4128 Task: ACQ Account: 3540 SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION I. Recommended Action: A. APPROVE Amendment to Right of Way Contract from Jeffrey & Cheryl Wirch. B. AUTHORIZE Public Works Director to execute said Amendment to Right of Way Contract on behalf of the County. C. APPROVE payment of $100.00 for said Amendment to Right of Way contract and AUTHORIZE the Auditor-Controller to issue a check in said amount payable to Jeffrey Wirch & Cheryl Wirch, 2882 Miranda Avenue, Alamo,to be forwarded to the Real Property Division for delivery. I1. Financial Impact: Payment of $100.00 from Road Funds (35%), State Transportation Development Act (19%), Deferred Improvement Agreements (9%), and the Alamo Area of Benefit (37%). III. Reasons for Recommendations and Background: This Amendment is for compensation for fencing that was damaged and/or removed during construction of the Miranda Avenue Bike Path project. IV. Consequences of Negative Action: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications.
