BRAGDON �� County DIRECTOR OF COMMUNITY DEVELOPMENT °a' - DATE: FEBRUARY 4, 1992 SUBJECT: AUTHORIZE COMMUNITY DEVELOPMENT DIRECTOR TO SIGN CONTRACT FOR PREPARATION OF AB 939 INTEGRATED SOLID WASTE MANAGEMENT PLAN AND REQUIRED ENVIRONMENTAL IMPACT REPORT SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize the Community . Development Director to sign a contract with EIP Associates for up to $180, 000 for the preparation of the mandated AB 939 Integrated Solid Waste Management Plan and for the preparation of the necessary Environmental Impact Report (EIR) on the Plan. FISCAL IMPACT None to the County General Fund. Carry-over funds from FY 90-91 AB 939 Tipping Fees were specifically earmarked for the costs of preparing the countywide Integrated Solid Waste Management Plan and the EIR on the Plan. BACKGROUND/REASONS FOR RECOMMENDATIONS AB 939 & AB 2707 requires that all cities and the County prepare and adopt Source Reduction and Recycling Elements (SRRE) and Household Hazardous Waste Elements (HHWE) . The Elements outline programs which will be implemented to divert solid wastes from landfill disposal by 25% by 1995 and by 50% by 2000. Additionally, a countywide plan--the Integrated Solid Waste Management Plan--must be submitted". The Integrated Solid Waste Management Plan must consider the programs proposed by each city and the County must describe how all the programs will be coordinated and integrated to achieve the mandated diversions. Authorize Director to Sign Contract for a 5 3 Preparation of AB 939 Integrated Solid Waste Management Plan and Required EIR Continued -- Page Two Additionally, the Integrated Plan must describe the solid waste facilities which will be needed to meet mandated goals, including landfills, transfer stations, material recovery facilities, composting facilities, interim processing centers, drop-offs and buy-back centers. The Plan must also address how these facilities will be used. Due to the failure of legislation (AB 2092-Sher) which proposed an extension of submission deadlines, the submission of final countywide Integrated Solid Waste Management Plans was due January, 1992 . Only one of the 13 counties required to submit final countywide Integrated Plans in 1992 have done so. Completion of our countywide Integrated Solid Waste Management Plan is scheduled for June, 1992--which would comply with the failed AB 2092. It is expected that new legislation is being introduced to replace AB 2092 . The integration and analysis of all jurisdiction SRREs and HHWEs and the integration of approved and proposed solid waste facilities combined with the limited timeframe in which the countywide Integrated Plan must be prepared and submitted, warranted use of a single-source consultant with knowledge of the solid waste issues and facilities in Contra Costa County. For this reason, EIP Associates was selected. EIP Associated prepared the EIR on the 1989 County Solid Waste Management Plan (CoSWMP) , on the Acme Transfer Station, on the County General Plan, and will be preparing the EIR on the Transfer Station/Material Recovery Facility proposed by Delta Diablo Sanitation District. Use of the EIP Associates was reviewed with the Administrative Committee of the AB 939 Local Task Force in August and September, 1991; the Administrative Committee concurred with the reasoning and the selection of EIP Associates. At the time, all cities and the County have completed preparation and review by the Local Task Force of their preliminary SRREs and HHWEs. Final SRREs and HHWEs. have been submitted by Richmond, San Pablo, Pinole, Hercules, Pittsburg, Antioch and Brentwood. As soon as State comments are received, final SRREs and HHWEs will be completed .and submitted by the County, Pleasant Hill, El Cerrito, Martinez, Clayton and Concord. The cities of Danville, Lafayette, Moraga, Orinda, San Ramon and Walnut Creek have advised us that they will not submit final SRREs and HHWEs until April/May, 1992, after completion of the EIR by the Central Contra Costa Solid Waste Authority. This EIR is being prepared by the Central Contra Costa Sanitary District, in part, because of the proposal for a Transfer Station/Material Recovery Facility, Household Hazardous Waste Holding Facility, and Composting Facility proposed in the SRREs and HHWEs for the cities participating in the Central Contra Costa Solid Waste Authority or having a franchise with the Central Contra Costa Sanitary District. It is expected, however, that we can complete the countywide Integrated Solid Waste Management Plan using the information and .programs contained in the preliminary draft SRREs and HHWEs of these central county cities. CONSEQUENCES OF NEGATIVE ACTION Without authorization for the contract with EIP Associates, the Integrated Solid Waste Management Plan and the necessary EIR will not be expedited. The mandated submission will be further delayed. While the State has indicated that no penalties will yet be imposed, the power to levy penalties of up to $10, 000. 00 per day does exist.
