SUBJECT: LEGISLATION: S. 1463 (John Breaux of Louisiana)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in OPPOSITION to S. 1463 by Senator John Breaux
of Louisiana, which would turn over to the U. S. Army Corps of
Engineers the responsibility to regulate wetlands and determine
what type and amount of development would occur on such wetland
areas .
BACKGROUND:
The Audubon Society recently wrote to the Board of Supervisors
urging that the Board oppose HR 1330 and S. 1463, identical bills
which have been introduced into Congress .
The request was referred to this office for a recommendation. We
asked the Community Development Department for their analysis and
recommendation on what position the Board should take on these
two bills . Attached is a memo from Roberta Goulart, Senior
Planner in the Community Development Department, recommending
that the Board of Supervisors oppose both bills and providing
reasons in support of this recommendation.
In view of -the fact that both bills use the U.S. Army Corps of
Engineers definition of wetlands, which is apparently more
restrictive than that supported by the County General Plan, would
fail to afford additional protection to other wetland areas, and
would eliminate the 'right of the EPA to veto a permit issued by
the Corps, staff is recommending that the Board oppose HR 1330
and S. 1463, as was requested by the Audubon Society.
