This application is presented on behalf of Mr. Alan Beall for the claim dated December 26 , 1991 (stamped "received" by your office on December 30, 1991 ) . 1 We respectfully request that you grant permission to present a claim which you deemed not timely presented by letter on January 3, 1992, under Cal . Govt. Code 911 . 4 (a) (Deering Supp. 1991 ) . This application should be granted because the six-month time limitation does not apply to this situation. Mr. Beall seeks only to recover private property wrongfully confiscated2 by the Contra Costa County Sheriff-Coroner Department ( "the Sheriff ' s Department" ) ; it is not in actuality a claim for "money or damages" under section 905 of the Government Code: [W]e observe that the language of section 905 makes clear that the requirements for presentation of claims apply only to "claims for money or damages" and not to claims for other forms of relief, such as specific recovery of property taken by the city as a bailee. Minsky v. City of Los Angeles, 11 Cal . App. 3d 113, 520 P. 2d 7261 730 ( 1974 ) . Mr. Beall only wishes to recover a specific piece of private property taken by the Sheriff' s Department: his Derringer. Therefore, this application should be granted because the six-month limitation does not apply to the facts of this case. Alternatively, we submit that Mr. Beall' s failure to present a timely written claim was the result of mistake, inadvertence, surprise, or excusable neglect, under Cal . Govt. Code § 911 . 6 (b) ( 1 ) (Deering Supp. 1991 ) . Mr. Beall had numerous conversations with members of the Sheriff' s Department in attempting to retrieve his Derringer within the first six months of this incident, beginning in February, 1990 . It was only after it became apparent that such good faith efforts would not be fruitful did Mr. Beall begin formal written proceedings to retrieve his Derringer. Therefore, the delay was reasonable and excusable under the circumstances . Although a formal written claim was not presented until December 26 , 1991, the Sheriff ' s Department did have notice of Mr. Beall' s claim through his conversations with various Sheriff 's Department personnel . Therefore, the inadvertent delay in filing a written claim did not prejudice Contra Costa County. ATTAC71MENT TO CLAIM OF ALAN BEALL 1 . The damage, a loss of property belonging to Alan Beall, occurred on February 21, 1990 . On this date, Detective Ed Munn of the Contra Costa County Sheriff-Coroner Department (the "Sheriff's Department" ) erroneously authorized the release of evidence and property, a Remington . 41 cal. Derringer, serial number 22 (the "Derringer" ) , to Mr. Donald M. Gibbs . See, Exhibit A. The loss of property may have occurred at a later date if the Derringer was actually delivered to Mr. Gibbs after February 21, 1990 . See, Exhibit A. 2 . The damage occurred in Contra Costa County, Martinez, California, at the Sheriff ' s Department, where the Derringer was erroneously released to Mr. Gibbs . See, Exhibit A. 3 . The Sheriff ' s Department erroneously believed that Mr. Gibbs was the rightful owner of the Derringer and released the Derringer to Mr. Gibbs on February 21, 1990 . Mr. Gibbs was a victim of a burglary, when his motor home was burglarized. See, Exhibit B. Several guns and $400 in cash were taken from Mr. Gibbs ' residence. One such item was a Derringer, serial number 22 . The burglary occurred on April 15, 1988. On April 4 , 1989 , Mr. Beall purchased the Derringer in Aspen, Colorado, for $1 , 260 . See, Exhibit C. Mr. Beall attempted to register the Derringer with the Honolulu Police Department. Because its serial number ( 22 ) matched Mr. Gibbs ' serial number on his Derringer, the Honolulu Police Department believed the Derringer was stolen and confiscated it on December 11, 1989 . See, Exhibit D. The Honolulu Police Department in turn delivered the Derringer to the Sheriff ' s Department on February 21, 1990, who released the Derringer to Mr. Gibbs . Mr. Beall spoke with personnel of the Sheriff ' s Department on several occasions ( 10 to 20 times ) regarding the return of his Derringer. Mr. Beall spoke with John Paty and Detective Adkins, among others . These telephone conversations. between Mr. Beall and the Sheriff 's Department took place within six months of the confiscation of the Derringer. 4 . The Sheriff ' s Department caused the damages, loss of property, to Mr. Beall because it erroneously and negligently released the Derringer to Mr. Gibbs without properly assuring that the Derringer stolen from Mr. Gibbs was the same Derringer purchased by Mr. Beall in Aspen, Colorado. Mr. Gibbs stated in the police report that "several of the guns had his initials '.DMG' engraved on the grips . " See, cpc/05525/0007/letters/Brd.Sprvsr Exhibit B. However, nothing in the record shows that such initials were found on Mr. Beall' s Derringer. In fact, there is a notation in the record from a John Paty, that the Derringer was returned to "our" owner (presumably Mr. Gibbs ) and that it was subsequently engraved and nickel-plated. See, Exhibit E. This tends to show that the Derringer was not previously engraved with Mr. Gibbs' initials . Although Mr. Beall's Derringer' s serial number was also numbered "22, " such Derringers have had identical serial numbers for different guns . See, Exhibit F. In fact, the collector cited in Exhibit F owned two Derringers with serial number one. Therefore, the Sheriff ' s Department had no means of determining whether the Derringer was in fact the Derringer stolen from Mr. Gibbs . The Sheriff 's Department should have known this and should not have given the Derringer to Mr. Gibbs . 5 . Detective Ed Munn, who authorized the release of the Derringer to Mr. Gibbs, is the responsible county officer or employee who caused the damage or injury to Mr. Beall . See, Exhibit A. 6 .
