Contra � Costa unty TO: BOARD OF SUPERVISORSc FROM: TRANSPORTATION COMMITTEE DATE: November 30, 1992 SUBJECT: Report on use of Navy Mitigation Funds for support services to the Greater East Bay Rail Opportunities Coalition SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Authorize an increase in Navy Mitigation Funds from the current expenditure limit of $23 , 000 to a revised limit of $32 , 000 for use by the Director of Community Development to amend a Consultant Services Agreement with William R. Gray & Company for support services to the Greater East Bay Rail Opportunities Coalition. FISCAL IMPACT There will be no impact to the County General Fund. The Navy Mitigation Money Expenditure Plan allocates $250, 000 to rail studies. The amendment to the Consultant Services Agreement will be funded from this allocation. BACKGROUND/REASONS FOR RECOMMENDATIONS On June 16, 1992, the ,Board of Supervisors authorized an amount not to exceed $23 , 000 in Navy Mitigation Funds for use by the Director of Community Development for a sole-source Consultant Services Agreement with William R. Gray & Company to provide support services to the County' s Greater East Bay Rail Opportunities Coalition. The last invoice submitted by contractor exceeded the agreement limit by $9, 000. The draft JEPA has been forwarded by the Coalition to member jurisdictions for their consideration. Although the County is not obligated to pay any invoice beyond the $23 , 000 authorization limit, Community Development Department staff indicates the draft JEPA is needed by the Coalition and recommends payment of the full invoiced amount. Staff has directed the consultant to cease any further work pursuant to the agreement. Any further work for GEBROC support services would require a separate Consulting Service Agreement. The Board' s adopted expenditure plan for the Navy Mitigation Funds allocated $250, 000 for "rail studies. " Approximately $30, 000 of this allocation has been used for the Contra Costa Rail Opportunities Study. The current authorization limit for the Consulting Services Agreement with William R. Gray & Company is for $23 , 000. By increasing this authorization limit to $32 , 000, the remaining uncommitted balance in Navy Mitigation Funds for rail studies will be $195, 000. The Navy Mitigation Fund Expenditure Plan requires any funding recommendation be forwarded by the Community Development Department, through the Transportation Committee, to the Board of Supervisors. The Transportation Committee concurs with staff' s recommendation considering the value of the service provided. However, the Transportation Committee expressed considerable concern regarding the potential precedence that might be established by reimbursing the consultant for work beyond the contract's specified limit, and for not be notified by the consultant that the the spending limit has been reached before additional charges where made. The Transportation Committee has requested County staff to remind the consultant, in writing, of the contract provisions that limit the County's financial commitment to the amount specified in the contract, and that any work beyond that amount must be authorized beforehand through a contract amendment.
