SUBJECT: Hearing On Appeal By Trail Users Coalition on Condition
#14 Of approval For Minor Subdivision 55-90, Deborah
Gustin, Applicant and Owner, In The Martinez Area.
On November 24, 1992, the Board of Supervisors continued to
this date the hearing on the appeal by Trail Users Coalition from
the decision of the Contra Costa County Planning Commission
whether a condition of approval for Minor Subdivision 55-90
(Deborah Gustin, applicant and owner) has been met.
Dennis Barry, Community Development Department, commented on
a fax letter from Ganong and Michell, attorneys representing the
Trail Users Coalition, requesting a continuation of the matter
before the Board today.
Supervisor Torlakson advised the Board of the two field
trips taken on the site and commented on the key issues,
including an alternative access for cars, preserving the feeder
trail for horses and hikers, and the issue of a side by side
separated trail use. Mr. Torlakson suggested taking testimony
today from the applicant since there had been previous testimony
from the appellant, and then to request staff to come back with
further recommendations after consulting with County Counsel and
the Fire District on the feasibility of different alternatives.
Scott A. Sommer, Tobin and Tobin, 1676 North California
Boulevard, Walnut Creek, representing the applicant, presented a
brief history of the feeder trail, and he commented on issues
including the amount of acreage being requested for dedication as
a conservation easement, and he requested more direction from the
Board as to what approach to pursue, the alternate access or the
current right-of-way.
Supervisor McPeak clarified that there had been a discussion
about an alternate access which was less supported than using the
current access and providing separation between the trail and
automobile uses.
Supervisor Torlakson concurred that it would be more
fruitful to pursue the separated access or using the current
right-of-way with the separated trail in that right-of-way or
bringing the trail up higher on the ridge.
Mr. Sommer suggested a meeting with County Counsel, Mr.
Torlakson, .the applicant, and the appellant in attendance tow
work on the issues.
Supervisor McPeak requested that Supervisor Torlakson work
with Supervisor Fanden, Supervisor-elect Smith and pull the
parties together for a resolution of the matter.
Julian Frazer, 2415 Alhambra Avenue, Martinez, member of the
Martinez City Council, spoke in favor of moving off the trail in
some places completely and trying to find a way to get the trail
off toward the top part of the ridgeline.
Supervisor McPeak inquired as to whether Mr. Frazer
represented the City of Martinez in this dialogue.

Mr. Frazer indicated there was some support for the issue
and that it was adjacent to the City of Martinez sphere of
influence and within the City of Martinez sphere of interest.
Steve Fiala, 2950 Peralta Oaks Court, Oakland, Trail
Specialist, East Bay Regional Parks District, endorsed the idea
of a work session to resolve some of the issues to preserve this
historic trail and to address some of the issues related to the
subdivision proposal.
IT IS BY THE BOARD ORDERED that the hearing on the above
matter is CONTINUED to January 12, 1993, at 2 p.m. in the Board
chambers; and Supervisor Torlakson and Supervisor Fanden and
Supervisor-elect Smith are AUTHORIZED to meet with other
interested parties including the land owner and staff to look at
the technical issues to come up with an approach on alignment and
how it can be achieved.
